CSA wants my driving licence when I don’t drive!

Wow your website is a real eye opener. I have been battling the csa for 10 years now, they have failed to assess my current circumstances which reflect payments owed.

The story is verrrrrryyyyy long but to cut this short, they have sent me a letter saying they are applying to take me to prison or disqualify from driving (dont drive), they have set a court date for the 1/5/10, i am sick of trying to sort this with the csa, it got to a point where i was that fed up of trying to sort the matter out that i just ignored there letters, i was at the end of my tether.

What is the likely hood of myself going to prison? i am not refusing to pay, i just want a proper payment arrangement. They are demanding that i pay 6500 in full, which i just havent got.

Even if i offer in court to pay something, can they dismiss this and still send me to prison? I have 2 other children to my current partner aswell. If it wasnt for my kids then i would end it all, ive had enough.

    Hi pughy,

    In order to secure a disqualification or committal, the agency have to be able to prove wilful refusal or culpable neglect.

    The court MUST enquire into the NRP’s means/whether they need their driving licence.

    Instead of immediate committal, the court usually fixes a term of imprisonment, postponed on conditions ie regular payments.

    – It would be advisable to prepare a statement of in comings and out goings for the court, which will enable more achievable regular payments to be decided.
