Lost my house because of Child Support Agency
The CSA run up debts (mine) of £14,000 resulting in coming to an “agreement” (blackmail) by my ex to sell my property and pay her £5000 in cash – the CSA told me they would writ ethe other 9k off and I would effectively start again – they advise dme she could not go back on her word (she did) and they then demanded the other 9k meaning I was now renting just as house prices went through the roof (am still renting 7 years later) they then took me to court and found me guilty of wilfully obstructing payment (I wasn’t) and more recently had £400 to get through December with – they took half of it or I would be sent to jail – I got a letter this morning saying as you are aware on 19/09/07 42 day commital sentence suspended you must pay £200 a month.. contact me urgently..
what do I do? I don’t have it, I am at my wits end and sick and tired of having my life ruined, stressed out and suicidal.

Hi Philip they cannot send you to prison and they have no lawful jurisdiction to demand any funding from you. We have been representiing a few fathers over the past twelve mionths who have been summonsed to court for committal proceedings and we dismissed the Magistrates and the CPO of the CSA.

Are you CS1 or CS2?
Are you satisfied that the arrears amount of £14k is correct and based on a proper calculation and not a penalty assessment?
Are you liable for regular maintenance payments at present and arrears OR is your case arrears only?

I am CS1 and the amount was £14,000 I sold my house after “agreeing” a settlement of £4000 (I couldn’t get a loan as I already had one for car)
It was based on assessments carried out without my knowledge and whe I challenged it they said I had to challenge within 12months of the assessment being made (they’d written to my old address and when I challenged them on this they then told me they were not the CSA but the appeals service) in court I argued but wa stold by the judge it was done correctly and therefore the debt would stand Inow owe £8200 I pay regular maintenance of £100 and £100 towards arears.
My ex went back on her word and whilst she did write of the arears she then changed her mind after i’d sold my home and gave her £4500 in cash – the csa sent me acheque for £50 for wrongly advising me… I took a call threatening me with 42 days imprisonment (again) it’s becoming a monthly call and too much stress – my ex has FIVE houses.. I am quite upset about this and have no idea what Ican do.

You need to find out if any of the assessments were penalty assessments, which could have inflated the arrears and could be converted into a proper assessment.
If your ex was on benefits during the period the alleged arrears accrued, then she would be unable to have any preference whether they were collected or not, as the arrears would be owed to the secretary of state.
I know its easier said than done, but stay calm, in order to achieve a committal the agency have to prove wilful refusal or culpable neglect, you are continuing to make regular payments, so neither apply.
Take to streets..this country and the CSA is corrupt!!
