Is there any way of standing up to the CSA? Is there any legal’s out there that may be able to help us all?

My partner has had similar trouble as all of you with the CSA. 6 months ago they just started taking money from his wages – no contact with him, nothing! He didn’t even know he was a father!

So he requested a DNA test, but the CSA said the case was 5 years old…that’s right 5 years! they wouldn’t do anything and he had to pay. Basically they said they have been sending letters for the past 5 years and he hadn’t replied basically saying that was as good as admitting he was the father. But we received nothing. Bearing in mind he has been electoral role registered at every address.

Anyway, he had to pay to take the mother to court to demand a DNA, then had to pay an external company to do the test, and pay the doctors surgery to do it. The cost was over £700, just to find out! Anyway, it turns out the child is his. We are sad as he has missed 5 years of that child’s life due to no one contacting him sooner.

Of course he is happy to pay maintenance for the child, after all he is his, however, the CSA are taking £400 a month – surely having a kid does not cost over £800 a month – I am assuming parents should be paying half each for their children. I am in the final year of my degree as a mature student so unfortunately don’t earn. We are barely making rent each month let alone paying bills etc. We even had to move into a cheaper house in January so we still had a roof over our heads! We now go to my parents for teas most nights as we can’t afford a month’s worth of food anymore!

On contacting the CSA numerous times, they have said that they are not taking the money but a debt collecting agency is, even though it says CSA on wage slip. They gave details of the agency ‘apparently’ taking the money but on contacting them, they have no details of my partner. When we rang the CSA back they told us another company – again who didn’t know him. It has been back and forth for the past few weeks!!!! It appears the CSA don’t know or won’t tell us who is taking money from him….surely this is stealing???

Please help! We need to press legal action against them; we can’t let them get away with this over and over again.

    Ah the usual scam used by this corrupt agency , they say they have sent out letters over the past 5 years which they don’t they use the statute known as a law to hide behind behind because it states in the Child Support Act that the Agency only have to say a letter is posted and it is deemed as served the day after, they are using this scam to issue illegal DEOs. It is helping them rake in more money to pay off their multi billion pound debt.
    Did the employer inform your partner in writing that the CSa had been in touch with them and did he consent to the fact that he was the liable person, did the CSA produce and documentation to your partners employer to prove he was the liable person, if not then his employer has breached the data protection act so you could sue the employer.
    As far as the CSA operate they are corrupt, and they are colluding with the courts system which we have evidence of now, but at the momemnt there is nothing you can do legally with them.
    However don’t be disheartened because we now have things in the pipeline that is going to blow this whole CSA/CMEC out of the water and ministers are going to go into hiding.
    In the mean time request your Data Protection Prints from the CSA, DPA will include wverything that the CSA hold about your partner and if they say they have posted letters out then they should be in with that pack, if not then you can come at them from a different angle.

    Try Burtons Solicitors in Lincoln, but you need full legal aid or Forshaws in Cheshire, there is not many Solicitors who will take them on and you have to be able to get legal aid! Because I got an advance payment due to Watchdog getting involved, I stopped the Solicitor with continuing – big Mistake. I cant get legal aid at the moment, but my contact ends in July so will try for it again then, but in the meantime will keep trying Watchdog and other media, if there are enough of us, they will do a story, the media is one of the best options, it worked for me but as Im still owed money, will keep trying again.

    i’m homeless currently having to doss on freinds sofas as the csa have decided that they are entitled to 40% of my wages leaving me with just over £500 a month to live on, i was expected to pay rent bills and food. i’m at my wits end i can not live like this for the rest of my life, i may as well be dead!

    HOW CAN THE CSA SAY THAT THE COST OF BRINGING UP A CHILD IS A DIFFERENT AMOUNT TO EVERYONE ELSE LIKE FROM £50 TO £800 A MONTH, THERE SHOULD BE A SET FIGURE. IF YOUR ON BENEFIT WITH ONE CHILD AND THE FATHER IS DECEASED HOW MUCH DO YOU GET FROM THE GOVERNMENT FOR THAT CHILD INCLUDING TAX CREDITS I BET ITS NOT ANYWHERE NEAR £800 A MONTH. ALSO HOW IS THE NRP SUPPOSE TO BE ABLE TO DO THINGS WITH HIS CHILDREN IF HE CANT AFFORD TO TREAT THEM WHEN THEY VISIT.
