CSA paid money meant for me to someone else!
My son was born in 1993 and I was in receipt of income support at the time. When my son was 6 months old the CSA wrote to me and told me my benefits would be cut if I didn’t submit an application for child maintenance through them.Which I did.
Well it took 14 years for me to get any maintenance from the absent parent, despite informing the CSA often of where he was living and where he was working. A Liability order was sought and won through the courts, but he still didn’t pay, so the CSA went to a Commital hearing. The court orered him to pay £150 to me every month to clear up arrears of almost £25,000.
Anyway, he has been paying regular payments for approximately 18 months now, but the CSA telephoned me 2 weeks ago to say that now my son was 17 and no longer in education the maintenance was no longer payable and my case will be closed, BUT, the arrears were still payable and I would continue to receive payment under the court order until they had been paid.
November’s payment never made it to my bank account, so I phoned the CSA and they reassure me they will contact him to make payment.
I then get a phone call yesterday to say that he had actually paid November’s payment, but because a new claim has been filed against him (his ex wife) the money he paid to me has gone straight to her and I will not be receiving anymore money until they have re-assessed him and may even need to take him back to court to get my money. Apparently as my case had been closed, even though there were arrears on the account, all money received from the absent parent goes into a pot and new claims will get their share first, meaning there is no money left for me and my son.
Now bearing in mind my payments have been made under a commital order and I waited 14 years for any money, his ex wife’s claim was only made two weeks ago and she has received MY money already.
I believe they have illegally given her money ordered to me under a court order between myself and the absent parent. It’s like given someone’s compensation to somebody else as they made a new claim after.
I am going to fight them every step of the way over this.
Beware when involving the CSA. I had no choice but you do. Come to an amicable agreement with the absent parent if you can.

The CSA are corrupt and think that they are above the law, they cause more problems between the PWC and NRP. They are an absolute shower of shit

This is just typical of the Csa! They are just a bunch of incompetents that are determined to destroy as many families as possible and financially destroy everyone they come in to contact with. Get down your MP now! This totally corrupt organisation must be closed down now! And be made to pay damages to everyone affected by their gross incompetence!
Exactly the same happened to me. My irresponsible ex gets his secretary pregnant and all of a sudden arrears owed to me since 1993 all go to he. What happened to dealing with cases in order in the eyes of the CSA youngest child is all that they are interested in. I got the CSA to put into writing the amount owed and now i will take it to court myself, Quite fancy having his new car hopefully the bailiffs will collect that.

Not exactly bright enough to preserve the tax free income is it???? however! it appears that CSADEO's are still being paid but she aint gettin it!!!!

Hopefully, Paula, you were just being funny about the car and didn't mean it. There are lots of NRP'S and NRPP'S on here who have lost so much because of greedy PWCs and the CSA and all they want is to see their children and to pay a fair amount and still have a life. I feel for women who have ex's who shirk their responsibilities – but that's not everyone and this site is here to try and offer support to all – not stir anger.
for the record my ex has many cars not just 1 and I am not a greedy PWC as i have experience with the CSA as a NRP and PWC. What I cant get my head round is I have to pay for my daughter and my ex doesnt pay his arrears for my son, A fair system is what I would really like!
no arrears to you is yours end of they cant touch it and his ex wife as no claim to it either
they cant stop you getting your arrears its your end off your legal right to it all of it
anything they paid her out oof your money owed to you they legally must recall it back from her or get her to prepay it to you at affordable amounts giving her a months notice she been overpaid by your money in error
the only way she can have a cut in your maintance arrears is if she claiming for the same dates
csa DO make new change of circamstances worng and claim they are right you and wrong tough get on with it this is against the law, and then to assume you you no longer have any money due to you is out of order
Apparently my case has been passed on to criminal compliance, does anyone know what this means and has anyone had any success with this I have battled for almost 10 years with CSA and although payments do come they are always late sometimes by 3 or 4 months as maintenance was more than income support I could not claim while waiting for payments. NRP is self employed and until recently director of his own company, which has also made it even more diffucult for the CSA to collect money even with a DOE order. What a nightmare this whole situation is, CSA have never made any contact with me regarding the fact they are having trouble collecting money or that they have passed on to criminal complience and its now out of their hands so what do i do now ??????
