CSA harrass me and my husband on a weekly basis
I have written here before but issues with the CSA continue to escalate and cause daily misery.
My husband is being pursued for a liability order of £35,000! He was forced to leave a professional career when a DEO left him with not enough to live on. For a period he lived with various relatives in a state of shock and depression. The CSA continued to accumulate arrears based on his previous job even though they were aware he’d left. He went to stay with family as his Father ws terminally ill. Obviously all arrangements were informal so no evidence to prove or dispute this.
Eventually, he agreed to settle down with me and raise my two children which he’s done for the last 17 years. I have received NO maintenance from my children’s Father as he decided to move abroad to avoid paying. What astounds me is that the CSA just open and shut my case because he is out of jurisdiction so there are no arrears accruing. I am fully aware that once my youngest child is 19 and the CSA no longer are interested that he can return to the UK free from debt or responsibility.He has no other children.
My husband and I live in misery due to the constant almost weekly harrassment and menace from the CSA. My husbands case is with ICE but that doesn’t seem to make any difference.The CSA have said in a letter that they are not interested in any information about his employment history as it won’t change any assessments retrospectively. They ar offering an interview but when they called yesterday and I spoke with them about the purpose of this I was told that they are not interested in information from us and it won’t make a difference. Is it worth going for an interview? has anyone experience of this? or is it just rubber stamping their position…
Finally, has anyone considered the European Court? I know there was a case years ago but I can’t find anything on the outcome. Are there any solicitors out there who could advise? We have no income as our business is failing partly because I have seriously ill health. Our lives are in ruin. Our children are distraught and it just seems so unfair that the CSA are selective in the children they chose to ‘try’ to support. Why should my two children be penalised? It really amounts to stealing from them to fund the lifestyle of another.

Please see your mp, we have just had an interim assessment overturned by the help of our mp, now we are fighting to get our overpayment paid back to us because csa have dragged our case on for too long knowing they had made mistakes….apparently they gave 1800.00 to the pwc for a period she was on benefits, so should have only been entitled to 700.00, but csa claim we can’t have it back because the pwc thought she was entitled to it..its all b******t…the mp wants us to pursue it and demanded compensation from the chief executive.
Keep on at the mp until something is done, throw in your childrens human rights and how csa have ruined their quality of life. Might also be worth getting your husbands file to see what info they hold on his case, this cost a 10.00, do it sooner rather than later.

As Jo says keep fighting. It is hard, will grind you down, but don’t give up!
We got our MP involved aswell and it did help from the point of view that CSA eventually listened as our complaint letters would not even be replied to.
CSA will tell you anything over the phone to make you doubt them but do not listen. I had to listen to them threatening me they would put order over my house which is in my sole name, but they were trying to say because he lives here they would, which is obviously lies.
My partner had initial arrears of £49,000 after MP help, reduced to £31,000. We are now appealing, even though CSA has tried to say it is time barred, the tribunal overruled and will allow our appeal. The assessments in partner’s case go back to 2003.
As Jo says get a copy of your file. It costs £10 and you get it from Data Protection Unit, CSA, Newcastle. They have 40 days to provide you with the file. We found alot of errors on my partner’s file such as correspondence sent to our current address 2 years before we moved here, assessments kept in place when he was in receipt of benefits, confirmation of CSA not dealing with file.
Best thing to do is stop telephone contact. Get your MP involved and you will get one person to contact who will update you. Carry on business with them in writing. Hopefully get your case to appeal stage.

Go through your MP. Your point of contact is at the bottom of the poorly trained pile. An MP goes in at a much higher level and they are used to dealing with the vagaries and unrealistic demands of this draconian and remorseless agency.
There is no doubt the CSA is the most evil, yet powerful, of government agencies. You have my utmost sympathies – they are about to tear my business apart and I haven’t slept for weeks. Ironically, my kids’ suffering has only increased since the unaccountable box-tickers started their campaign of interference and destruction. I have saved for 2 decades to build up something to support my kids and now it is being handed to my ex who has been sitting on her benefit-funded arsenal for 6 years, never lifting a finger.
It’s at times like this I wish Germany had won the war.
