CSA deducting money for child now aged 21

Years ago my husband got embroiled with the CSA for his then 4 year old son. He disputed having to pay CSA as the mother of the child who suffered with mental illness kept moving away leaving everything behind and he was constantly replacing furniture, clothes and everything. He gave her food shopping regularly and paid for everything his son ever had.

By the time he’d done all this he couldn’t afford to pay CSA and as the mother was on benefits if he had done so his son would have ended up worse off. This went on until the child was 9 at which point he came to live with us. We have never received any help from CSA and were still being asked to repay some £13000 whilst the child was living with us. Eentually we got them to agree over the phone and even at some point in writing (although I don’t know if we still even have this) that no further action would be taken. The last time my husband spoke to CSA was about 4 years ago.

Everything we’ve ever done has revolved around looking after this child, even to the point of putting off having our own child until it was all sorted out, which we eventually did when the child was 15. Now some 6 years later the CSA have suddenly without warning started deducting £335 per month from my husbands salary.

The child this relates to is now 21 years old and having a child of his own. How can it be right for my husband, myself and our 6 year old daughter to be worse off for all that we have done to take care of this child over the years!!!! I’m outraged, when my husband contacted the CSA today they basically told him there’s nothing he can do & that he’s not entitled to appeal.

We are now awaiting a call back from the depatment that issued the order, this could take up to 48 hours. In the meantime we are left struggling to cope with this situation.

    Hi Charlotte,

    Depending which system a PWC was on, prior to 27 October 2008 a parent with care on CS2 (new scheme) could only keep up to the first £10 of any maintenance collect by the agency. After that date the amount was increased to £20. The remainder was off set against the state benefits they received. On CSCS (old scheme) they received no child maintenance, regardless of whether any was collected.
    Since 12 April 2010 there is a total disregard and parents with care who are on benefit can now keep all of the child maintenance they receive.

    Therefore, any ‘arrears’ that accumulated prior to 12/04/10 are either partly OR fully owed to the Secretary of State.

    You are repaying the money to the secretary of state as the above poster says.

    Its because she went on benefits. And like it or not this amount will have to be repaid to the secretary of state. Unfair… yes… CSA bunch of ass munching gits… you bet ya
