CSA claims money I paid direct was a gift

When i split up with wife in 1999 she was on income support and all the other benifits going.

I payed money into her account for my 2 children. Since then she has remarried. When csa said i owe £15000 arrears i was shocked. They asked me for reciepts for the money i payed and now they are saying that ex wife is saying it wasnt for kids.

Now csa are saying they are classing all the money i paid as a gift. Well this is fraued. She was on benifits, why do women get away with this all the time?

I recieved a letter from csa saying one of my kids surname as changed to her new husband – can she do this?

  1. I’m not surprised the CSA considering your direct CM as a gift. This is because she was on IS the Government will keep most of the arrears they are trying to collect from you.

    To change a childs name, even unofficially, requires the agreement of all people with Parental Responsibility. Because you were married to the mother you automatically have PR. Of course, that doesnt stop the resident parent trying to do so anyway. You should point out the the CSA that you have not agreed to thge name change and it is therefore unlawful, and they should immediately refer to the child by their legal surname.

    If you want to push the point further with the mother though, you may have to obtain a court order to try to stop her. As you may already know, they often do whatever the hell they want ……

You can challenge this, go through the appeals process, they can take payments into account but then the debt would be owed by your ex, we did this and was successful because we could provide proof of payments, shame on her for trying to screw you further, join child support agency ripoffs on facebook for more info and help
