Would I have to pay for his child if I worked?

Hi all 🙂 new to this and i need a little information regarding my income being used in my husbands maintenance calculation (we all know what lying scum the csa are with their mixed anwsers & ‘laws’).

My husband has a child from a previous relationship who is nearly 5. he doesnt see her ( most of you will relate!) and we have 2 boys together that are 3 and 1 and i also have 2 older kids that are from a previous relationship. now, i know for a fact if your family are entitled to working tax credit/ child tax credit then they will ALWAYS take that into consideration so before he even works they assess £24 alone on maintenace for MY childrens tax credit alone to use for HIS child!

I have seen 2 sides to the csa where i can sympathise with being a pwc myself so i know what its like when lazy fathers refuse point blank to pay for their child which isnt fair on the pwc, yet, i have seen the way they treated my husband the past year and many other fathers and i can honestly say that the csa ARE NOT FAIR IN ANYTHING ESPECIALLY THE WAY THEY TREAT FATHERS THAT ACTUALLY HAVE NO PROBLEM PAYING FOR THEIR NON RESIDENT CHILDREN.

PAYING FPR THE ‘DECENT’ fathers, there is not problem. its the disgusting way THEY DEMAND THIS MONEY AND THE RIDICULOUS AMOUNTS THEY ASK FOR!. IM GOING TO CONTINUE TO WRITE THIS IN BLOCK CAPITALS SO I CAN GET MY POINT ACROSS.

I HAVE 2 non paying fathersd that refuse a penny towards their children which is disgusting consideration one had a big business and the other is self employed and has no on else to care for but his drinking habit!! then theres my husband, HE RANHG THE CSA TO INFORM THEM OF NEW EMPLOYMENT, SENT THE DOCS, AND EVEN KEPT RINGING THEM FOR CASE PROGRESS 4 MONTHS DOWN THE LINE SO HE STARTED KEEPING MONEY BACK FOR HIS DAUGHTER. ~9 MONTHS LATER~ HES SLAPPED WITH A £57 MAINTENANCE DEO AND TOLD HE WOULD HAVE TO PAY A £2,000 ARRERS FOR THE MONTHE THAT THEY WERE SUPPOSED TO HAVE BEEN TAKING MAINTENACE OFF HIM AFTER HED BEEN RINGING THEM AND SENDING PAYSLIPS IN TO THEM THEY DID THIS TO HIM!!

AT FORST DEMANDED TO HAVE AT LEAST £90 A WEEK TO COVER THEIR ARREARS MESS UP DUE TO LAZINESS BUT WE MANAGED TO PUT A COMPLINT IN WITH OUR MP AT THE TIME. HE WAS BEING BULLIED BY HIS BOSS TO DO MORE HOUSR WHICH HE COULDNT DO AS HE HAD TO RELY ON PUBLIC TRANSPORT TO GET TO AND FORTH WORK WHICH WAS AROUND 16 MILES AWAY. HE COULDNT COPE ANYMORE AND WAS LITERALLY FORCED TO QUIT HIS JOB!!!!!!!!!!!!

So to cut a long story short, he HEA DTHE WORKING TAC RUN ON FOR 4 WEEKS AFTERWARDS AND DID YOU KNOW THAT AFTER THAT FINISHED THEY WANTED£ 32 OUT OF MY ONLY INCOME AT THE TIME WHICH WAS MY CHILDRENS CHILD TAX??!! HE HAD NO BENEFITS OR ANYTHING JUST CHILD TAX SO HE WAS RESORTED TO GOING ONTO JSA BY OUR MP (WHO IS WELL AWARE OF THE BULLY BOY TACTICS CSA USE!!)

ANYWAY (normal font now 🙂 ) what i wanted to ask is does anyone honestly know that if I went back to work (because hubby isnt having any joy 8 months of being on jsa) with finding work and we dont have any family so one of us has to stay at home with the little ones for half day school and the other is 1, before anyone kicks off!!!!!…. would i be financially responsible for paying for HIS CHILD??

I dont think that i bloody should!!! i dont think he would have jsa anyway if ..IF i found work?? if he has nil income but household income and i refuse to pay WHICH I WILL!!!! what can they do??? Any anwsers would be great lovely people 🙂

    ive just read the post back (apologies for really bad spelling errors thats what i get for typing too quick!) yeah, i contacted inland revenue a few months ago and asked them if the csa had the power to deduct from my child tax credit and they said no, that was the first time they have heard of that. they said all the csa can do is ask if and how much child tax and if/or how much working tax we recieve as a household. im curious, if the csa said to me ‘ i have to pay child maintenance for HIS child i can point blank refuse, can they make me pay ??! because for start all credits are in my name ans it would be against the law to deduct from my bank account coz id sue the bastards.

    The CSA have not asked for partner’s income since 2003 when they stopped taking into consideration the affordability of maintenance to the NRP’s household.
    Nothing is taken from tax credits it is normally taken into account when making the maintenance calculation.
    I believe tax credits are not consider in the new CS3 system.

    im afraid they do bill, child tax credits and working tax credit are always taken into consideration. only time they arent is as you said, on the new system which is with the child maintenance service only. i have spoken to cms and they have even said to me that they are not like the csa using nrpp income and tax credits in maintenance calculations. thing is i have two cases myself, one with the csa and on thats had to be moved over to the cms because of after 11 years the csa failed to do fuck all about my first sons father so i worked with my mp and got the ball rolling. also i worked with my mp regarding my husbands case as well. there are so many mixed anwsers regarding tax credits. its got my blood boiling. they asked my husband last year about child tax crdit and fooled him into giving him anwsers when he said thats none of your business they turned around and checked anyway! theres no way around it at all. once they know were a family all they have to do is go through hm revenue and it will all be there because they have the ‘power’ (under child support law) to do so. if me and my husband ever split he would be screwed basically!! either way as a family we have to suffer because of the way the csa do the calculations.

    Yes on system CS1 and CS2 they include tax credits in the maintenance calculation.
    On CS1 they include NRPP’s earned income.
    On CS2 they do not ask about NRPP’s earned income.

    I refrain from calling anybody names or swearing on sites like this because it displays ignorance and a lack of control.

    I am not spending time (by the way I’m the same person that wrote the post guys:)) arguing with you when I know exactly what our circumstances are. And please dont try and belittle me with trying to act clerical. I want peoples opinions on here that have been targeted unfairly by the CSA not opinions of someone who works for the CSA that hasn’t got the information about the cms because they are two different sets of rules and regulations. The way you have explained your comments is exactly how another employee of the CSA has explained her comments.
