Will my wife’s earnings affect my calculations?

Hi guys,

So the usual story. I have been paying maintenance for my daughter since i split from my ex. I have remarried, have a son and another on the way. I have a Ltd company and had a period of no contracts for 10 weeks recently.

Kept paying the agreed amount from savings and selling my car but ran out of money and could keep up the payment. Now she has threatened with the CSA.

I have no problem paying if my daughter sees the benefit.

My wife is an employee of my company and we are now getting back on our feet but i am getting conflicting responses from the CSA advisors as to whether my wife’s earnings come into any calculations, can you help?

Any help is much appreciated.

  2. I am on p.a.y.e and my wife is also through the company. She’s not a share holder but we are considering it. It’s also a new company only 9 months old.

  3. If you run as a ltd company, you should really be receiving payslips even if you’re on your own, Providing these even if they say 0 hours worked is still evidence. the CSA can only take a percentage of your income, for 1 child its 15% of nothing

  4. sorry accidently sent that message, as I was saying, 15% of nothing is nothing…
    Now your ex-wife’s income is not taken into account, the bad part of the law is that “both parents have to provide for the child”. while this is actually fair, it’s bad because it’s so broad…

    Maybe on the statutory maintenance (or what you guys call CS3) they get that instant access to child tax credits… cs2 cases wont know you have tax credits unless you mention it, they’ll know, but can’t use it..
