Will CSA reduce my payments when my wage drops?

September 12, 2010

Hello i got divorced last year and had a solicitor and court agreement that i would pay the debt £206.00 a month of the ten year relashionship and one hundred pound a month for maintanace of our three children. And since then it is what i have done but in july my ex went to the csa i sent all the documents stateing the court agreement and the divorce papers stateing what was in place but they said its worth the paper its writen on and awarded her £219.94 a month and i still pay the debt.

I work on a holiday park and from october my wage will go lower will they change the payments to what my wage will be and is it worth going back to court as i dont see it is fair that i have to pay the debt and csa?

Thank you for your time.

Unfortunatley it is perfectly legal for your ex to do this, and that is why Courts are not supposed to award CM any more where the CSA can have jurisdiction. If you had a Solicitor representing you they failed in their duty of care to you!

Yes the CSA will reduce your liability but YOU MUST tell them immediately you income changes as it is only implemented from when they receive notifiction. Do so in writing via Recorded Delivery and emial if you can with an authomatic read confirmation.

I hate to say but after 12 months the Court order can be over-ridden by the CSA. They have real difficulty in understanding that people's pay rises and falls. You can apply at any time for a change of circumstances review and there is no limit to the number that you can request in a year so I suggest that you go down this route.Any decision that the CSA makes is open to review and I would suggest that you contest it.As far as paying debt, mortgage, buying food, running a car etc. these are all secondary for the CSA – they want the money and only the money
