Why must he pay after the ex said she didn’t want it?

I would just like to know if an ex partner sends a text to say that she does not want any more maintenance (my son way paying it voluntary up to this point) can she then decide much later on that she wants the money to be paid?

The CSA as they were then says he has to he has to pay all the back dated money to the time she said she did not want it.

We still have the text on the mobile so she can not deny it. My son was not allowed to get in touch with her and he did not have the money for a solicitor. Can he be made to pay her the money which she herself said she did not want – her decision not my sons.

  1. put simply a parent has a legal obligation to pay ansd the mum cannot change the law on this s1 CSA act 1991.

    in short the agreement would be illegal and so would not be enforcable in any court or tribunal

    you cant have a contract for

    so this answers the question

    however there are so many mums that say this to get rid of the dad thinking that if he doesnt pay he has no rights.

    thats bullshit

    buy payimg you prove that the child is his and as a result he will have parental responsibility/ authority. so can make any application to the court for any court order including a contact order

    so while there is a monetary loss you get to see your grand child
