What is the maximum a court can order you to pay out of benefits

My son was born in 1998, whereupon his mother immediately went back to her mother. After two years in the “family” courts I gave up. The CSA want £33,000 for the period 1999 to 2006, despite the fact I served a six-year jail sentence (for running a business the government disapproved of).

I’m now broke and on pension credit and means-tested housing benefit etc. The CSA are about to get me sent to prison, after a previous court appearance where the court ordered me to pay £10 a week. I can’t pay and am soon to go down.

My question is: what is the maximum a court can order you to pay out of benefits?

  1. The minimum is £5 a week, but if you got other paid for assets from your other business, they could be took into consideration. Look at it this way. You cant be charged for child support if not in reciept of an income while in jail can you! If you owe arrears it is perfectly pheasible for them to stop £10 from your benefits because of what you owe. Which is still peanuts really when you see what some NRPs are paying on here. Myself included.

  2. the court s do not have anything to do with csa payments,because i have been there to see if i can see my son but i lose in the end.so do you want to know why i lost. because i have meditation with my son and her boyfriend had to be there and thay made up so much bullshit i did not get to see my son.and i was out of work and i had to pay £40.00.which i did because i wanted contacted. SO IF YOU ASK ME ABOUT PAYMENT TO THE C S A DONT PAY ITS HARD ENOUGHT NOT SEEING MY SON ,SO HELP ME GOD I MISS HIM EVERYDAY THAT PASS.

  3. I really do feel for you dave. I lost contact with my only child through spite as well for almost 5 years. By the time i did regain contact with my only child, she was 17 and full of anger with me. Saw her for about 8 months, then one day, she gave me a load of abuse and i havent seen her since. yes it does hurt! All i can say is if you choose not to pay. what will your son think of you when he is old enough to understand? he didnt ask to be born did he! Hes your son wether you see him or not. And yes, it is a bitter pill to swallow. Been there as well.
