Nothing u can do . Unless u come to an agreement between you once he’s out of the uk he’s not liable
as she leaf u can get a court order to make her come back if she went with out your say so . U do not need to pay anymore if u wanted to stop that up to u just stop teh payment CSA is only for people that live in the UK as she not here no more she cant claim
The case will close as the children are no longer in the country. They will close it from the date they are told or the date child benefit ceased to be paid.
So no more maintenance is payable but the arrears is still due to the PWC or Secretary of State.
The money you are paying now will be used to offset the arrears.
You move to Australia. The other alternative is to make an emergency application to Court for residence of your children followed by an application for the children to be returned to the jurisdiction ie England. Then involve the Overseas child abduction unit and they will serve the documents on the High Court in Australia for the children to be returned to the UK under the Hague Convention. Good luck. But it may just be simpler to move there.
Hi the same thing happened to me in 2007
Be aware that the uk and Aus have a reciprocal agreement so she can claim child maintenance via the Australians which can be enforced in the uk. I am currently fighting 35000 worth of false back payments I suggest you get a written agreement or court order before she leaves
Stewart Hall is correct, as i am ALSO in the very same position.
Mine actually went WITH my approval on the basis that it was in the best interests of the kids (aged 6 and 4 when they went).
The Australian CSA are in fact extremely easy to deal with and now the CSA here in the UK are no longer responsible I deal direct with them.
As long as you have a date that they moved over there they are effectively no longer of a concern to UK CSA.
Get in touch with the Aussies, you may findypurself surprised at how easy they are to deal with.
They make our lot over here seem like the SS!
