We’ve overpaid by £4,500, now I’m worried we won’t get it back

Husband has been paying csa by DOE at £95 per week. His son has just turned 19 and when he called up last year was told that CSA rules are now aligned wiht child benefit and will continue till child is twenty!!

We have been in constant contact since september 2012 regarding the payments and been told yes he still had to pay.

Then out of the blue last week we get a call to say that he should have stopped paying in september 2012! so we have payed in excess of £4,500 in maintenance after chasing and even getting the payments adjusted for an overpayment in april of this year and now being told we may not be entitled to get it back!

not really sure where to go anymore or is it worth pursuing… does csa have to pay back the overpayment (they are quick to take it off you ) or do we have to pursue his ex partner?

  1. @ andrew jones..you pay til 20 because thats what the law says…not saying its right, but its the law for some stupid reason. @tracy melto…surely if they have deducted monies from you which you should not have paid its fraud. inform your MP and appoint a solicitor to sue them

You people dont seem to realise you dont pay the CSA, you pay ure ex-partner’s, You have over payed, and you are entitled to a refund, thats the good news, bad news is your going to have to go to court for it, and the chances of a judge taking money from a single mom / low income mom/family is slim to none, and would probly cost you double to get the right judgement.

    CSA wont get involed and will allways win this arguement on this basis, you overpaid without flagging a change in circumstance, you have to realise once we assess an nrp and run the sceduele we dont work on it further, if he pays it will sit in a hopper and once a month check for a payment, if he doesnt pay it will go to debt enforcement and they will “try” to get the nrp to compliant.

  3. Thanks CSA worker however we have been in contact with the csa every month since september 2012 and tried to get them to look into our case. Each time they said we still had to pay so how come they suddenly decide we dont???????????
    Surely its their mistake and they should be held accountable for it??
    Surely its down to the parent with care to flag a change to the csa also??
    GRRRRRRRR!!!!!!

  4. @ tracy Ignore the CSA worker above, she talks shit, seriously, make a complaint via email to complaints review, the will then go through the case with a fine tooth comb, they will then decide on what course of action to take ie refund, you dont have to go to court at all, unless your wanting a quick solution, but even then it still takes time, The CSA do not care whether you have overpaid and even when the case is closed they will find a way further down the line of saying you owe them money back, because they couldnt organise a piss up in a pub, honestly, do not deal with them on the phone, EVER!!! they will lie to you, give you flase hope and you can ring and speak to different people twice in a day the second one will tell you a completely different story, Get to your MP as well, make the CSA worker accountable for what you are going through, they have to be held accountable, they cannot carry on breaking the law,
