Week off sick and no pay but CSA is still taking the money

Hello, I’ve recently taken time off sick with a very sevear case of the flue (From the 15th to the 19th of October). Being completely bed bound and with no phone at home I was unable to inform the CSA that I was ill. I had taken the week off without pay as I am a contractor and earn nothing if I am not in work.

I contacted the CSA and they’ve said they are still taking money from me regardless and will roll payment over the following week as a short fall.

Please help as I did not earn anything so how can I pay anything?

    Unfortunately, you will still be liable for the week you had the flu. If you were on long-term sick you would need to apply to the CSA to have the decision amended.

  2. Same thing happened to my son. It was only two days off sick, but the CSA couldnt take their full amount. They took 40% of his salary the following week. Unfortunately it left him in a position were he couldn’t pay all his bills. He has been trying to get back on track since.

  3. I do sympathise with you, but the CSA aren’t bothered about you not being able to afford maintenance for that week.
    Your problems will start when they make up ficticious arrears and back date them years. I understand they let the figure reach £3,000, then they have power to send the baliffs.
    In the New Year, I think it would be a good idea to send the CSA a letter (recorded delivery), EVERY MONTH, asking if they’re are any outstanding arrears.Send a copy to your MP. If they don’t respond to the letter or say you don’t have arrears and in the future stitch you up with ficticious arrears, youll have a good case for maladministration.

  4. Better still; why do the CSA not send an annual statement????? because they are crooks i believe and know it.

  5. CSA will take on a re-assessment for someone who is long-term sick if they are informed of a CoC by the NRP or NRPE if they are unable to pay DEO. 1 week is not considered long term sick. If the DEO in place was unable to be paid during the week an NRP is off sick on nil pay or SSP the employer will make up any shortfall in subsequent weeks.

    If the DEO imposed is at max 40% and nrp employer is not able to re-coup the shortfall the accounts will be re-scheduled to bring the unpaid deductions onto a new deo, in effect the missed deduction will be added to the end of the arrears collection.
