The CSA does not listen

I called them in July last year to inform them that my husband had just been made redundant and again a week later to let them know we had set up our own business. I was advised to continue paying what was being asked from when he was working but I explained I have 3 children myslef and we can’t afford the money they wanted so I was told to cancel the direct debit and set up a standing order for the minimm payment of £5.00 until everything was sorted. In December 2011 I received a letter from them asking for our accounts which I filled in and sent back.

Our business is not in profit at the moment and I don’t see it going that way for at least another 12 months, so we are living on Child tax and working tax credit with no other income. I have had a letter today giving a payment schedule for exactly the same amount as what we were paying when he was earining 22k a year!! Of course I have just tried phoning and the computers are down.

In August 2011 I asked when they were likely to sort out a payment schedule based on being self employed and I was told it could take up to a year!

  1. I was told by csa that when my ex went self employed they couldn’t touch him for a year as they didn’t know what his earning will be until he submitted a tax return. I would write a letter of complaint and go and see your mp to sort it out, they don’t listen to mere mortals, so have to go higher. They ain’t a clue what they are doing.

  2. After a massive row on the phone I am still no further on! I have advised them that my husband and myself are 50% owners of our business and CSA have said that has nothing to do with it! The accounts I sent them in December shows a loss of £236.00 but CSA claim we are earning £110.00 per week! I got in touch with a CSA advise line, ok I had to pay a subscription but I think it’s well worth it. They have told me that 50% owners means CSA can only touch 50% working Tax credits, but no 1000% is being taken into account. If I was the higher earner they wouldn’t be able to touch working tax at all……so…..I have got another job for 3 hours a week which means of course as from next week I AM the higher earner. This is after CSA suggest I say the business is 51% mine which would land me in court for diverting money!!!!!! There arrears they claim we owe is huge but once I get their assesment which has now taken 9 months I can get an appeal out to them, see what happens then!
