The CSA are making us sell our house

I’ve accepted that despite my husbands ex stating in 2004 that she didn’t need any money that the CSA are now going to force a sale on our home.

Has anyone experienced this and what is thre process? Could we make her a lump sum offer? Or speak to the CSA solicitors asking them to allow us to control the sale so we can make the maximum from it?

Any advice is helpful.

  1. CSA do not have any legal jurisdiction to ‘force’ people to sell a house. Only persons that can sell a house are those on the deeds or those in possession of a repossession order.

  2. Disgusting that they can threaten this. I take it CSA are stating there are arrears so they are going to put an order over your house? They can’t force you to sell, but once you do sell the house or even remortgage then CSA debt would have to be repaid aswell as your mortgage. They threatened to put an order over my house aswell (in my own name) and I don’t owe arrears – it’s my partner got the debt and luckily he isn’t on the deeds!

    Do you believe the arrears figure? Get a copy of your file from CSA DPU Unit, Newcastle and try to fight them on it. We’ve been fighting for over 3 years now so it is a long road but worth it

  3. Update: we have received a letter from Dryden Fairfax solicitors. Stating that we need to fill out a form on who lives in the property and a letter on the reasons they should not seek to force a sale. We have been advised to take legal advice. We have an appointment for that purpose with durham legal services tomorrow.

    Anyone dealt with Fairfax?
