Son’s ex went to CSA behind his back to get more money

February 13, 2018

My son made a family payment plan with ex 3 years ago and pays maintenance for his 2 children direct debit and has never missed. Last year she moved so my son got to see the children less. From every weekend to every 2 weeks plus shared holidays. She now has informed CSA that she wants more money and back pay from last September. She hasn’t discussed any new payment plan with my son otherwise they could’ve sorted this our between them. My son is upset she has done this without discuss g it. Will he have to pay back pay as he did not know she had contacted the CSA? It seems so unfair this could have all been dealt with between them. He’s you g to struggle as he’s just in the middle of getting a mortgage buying a home so his children have their own room. He lives with his grandparents at the moment.

    Hi Linda

Sorry to read about your son’s predicament.

The short answer to your question, will he be responsible for back pay is NO!

If his ex-partner has recently submitted an application for child support, it will only take effect from it’s inception and will have no retrospective effect.

If your son wants further advice, he can contact me in the first instance at [email protected]

    All the best
