Should the CSA check that the PWC is eligible for money?

I am currently having between £400 and £650 taken out of my wages due to so called arrears from 1998 to 2002. The issues are as follows:

The CSA had me down as living with my parents during 1998 to 2002 although I have always informed them of any change of circumstance. The CSA claim not to have recieved any information I actually was renting (first private then with the local council) I have now sent the CSA my council tax bills for this period yet they have not reassesed me, what they have done is threaten to reasses me for an earlier period (1992 to 1997) which I was already assesed at £0 (they say this was a mistake on their part).

They also threatened to either put me in prison or send the ballifs round should I not pay the so called £8,000 arrears.

I also asked for them to check if the child in question was eligable (now 18) as she is working (maybe part time) and claims to be in full time education (although I have my doubts) The CSA have said it is up to me to find these things out and report it to the department that deals with family allowance, is this right ? surly it is up to them to check eligability ?

Any help i can get on this would be greatly appreciated. Is there an outside agency such as ombudsmen that deals with issues like this ?

  1. There is a Parliamentary Ombudsmans office. I had my case referred to them by my M.P.

Firstly you must complain to the CSA (keep everything in writing as evidence). If they fail to addres the issues you raise and go on to threaten you, then complain to the Independent Case Examiners office. If you are not satisfied with the outcome of your complaints then go to your M.P. If it is proven that the CSA have botched your case up by maladministration, ask for compensatory payments.

If the CSA continue to threaten you or botch your case up as a direct result of their errors, then ask your M.P. to refer your case to the Parliamentary Ombudsmans (PHSO) for investigation.

Word of warning. I have been through these processes and all the lot of them close ranks and carry on like it never happened.

    Good luck!

  2. Why don’t you know what your child is doing? Have you not bothered with contact and being there for your child?
