Self employed getting away without paying the CSA

I have had a constant battle trying to get maintenance for my 8 yr old daughter. Around 4 yrs ago a liability order was served for around £2000 of arrears this was half of the debt as they can only do a certain period of time. A court order was made for £50 a week regular payments and some of the arrears. Now he has gone self employed and I have received payments of small amounts for the last few weeks.

Now they are saying he has been self employed since 2006 and they are reassessing the case from then. It looks like his payments should be between £6-8 a week. He has also claimed since this date he has shared access. He hasn’t seen her in 4 yrs. Why do innocent men always seem to get shafted but men like him get away with it??

  1. I have been self employed long before I married and became a father.
    I pay my way for my child,however I still get letters about alleged arrears and threatening me with court action etc.
    Nothing comes of this because I pay.
    To say all self employed ‘get away with it’ or ‘don’t pay’ is just not so.
    The real problem is that the CSA spend too much time and resources on fathers like me who pay and not enough on those who don’t,whether they are self employed or not.

    1. Complain, ask for departure on lifestyle inconsistent etc

    3. Contact ICE (Independent Case Examiner)

  3. KMcQ79 – I am sorry to hear your experiences have been bad, however, as you say the CSA has never proceeded with enforcement because you pay. This is not the case with all NRPs. To say that self employment is not an issue goes against the grain when there are other posts on this and other forums advocating Self employment as a means to avoid paying CSA.

    My ex brandishes self employement as a way to avoid paying CSA, the arguement being prove I am working more than 16 hours. He is now claiming benefits which has reduced his claim further to £5 and stops the CSA being able to chase arrears. He is being chased by the HMRC for tax fraud and not declaring earnings yet the CSA say that they can only go by the amount he says he make. They have no way to check his earnings as he works for cash only and doesn’t keep a bank account. He has contributed less than £70 towards our daughters care in the last year, I have tried every option private agreement, direct payment, csa and he choses not to pay. He does not have any assets in his name so a liability order does nothing….. they cannot touch business assets.

    I work, pay taxes, encourage contact, I am not asking for excessive amounts meanwhile, my ex travels abroad, has just bought a porsche (fraudlently) can afford nights out and luxuries. I pay more than 60% of my wages on childcare, but this does not come into account with CSA.

  4. stop trying to use your kids and a financial sword to axe you ex husbands head off, get on with your miserable flecking life without his money, you greedy fat bitch, and your fanny is now for pissing out of so use it for that instead of cash machine.
