Self employed ex made just five payments in five years

I have been trying to obtain maintenance from my ex-husband through the CSA since 2007 for the two children we had together when married. To date I have received five payments over the past five years totalling £1250.

He is self-employed but I was assured at the outset that they had ways and means of enforcing the payment plan…ha ha ha! He knows that there is nothing they can do. He didn’t even bother turning up to the last court case so a warrant for his arrest was issued. Was he arrested? NO. He paid £350 and that allegedly stops the warrant for his arrest. He currently owes the best part of £10,000 but I doubt I’ll see a penny.

What makes me so mad is that I read stories on here (and know a few friends) who pay regualarly and are being stitched up with the calculations. My experience is quite the opposite…there is nothing the CSA can do to get regular payments out of my ex and he knows it. Swanning around in his new cars, going on regular holidays, his gym membership blah blah blah. But he is clever, he is renting a house and puts all his money into his girlfriends account.

Event he bailifs were next to useless….who would have known that they have to be INVITED in or else they are unable to gain access. Hysterical. I am one of the lucky few because I have a brilliant husband who has helped me to bring up my two children financially, but it pisses me off a bit that he can abuse the system and get away with it. And the ironical icing on the cake is that when my son went to live with him for a few months when he was 15 myy ex applied for maintenance from ME…and got it because I am employed.

I had to FIGHT to have it taken off what he owed me instead of him simply getting money off me. Outrageous. The CSA is a complete waste of tax payers money and should be scrapped!!!

  1. unfortunately this is common place for many who have NRP’s who are self employed – me being one of them, please see my you tube videos and join the facebook groups we have set up child support agencies failings and others for support and advice and hope it helps – get your MP involved and Criminal Compliance Unit. Good luck.

  2. It is a common complaint with self employed but the CSA allow it to happen. There are still ways they can check accounts etc. but don’t. It is just too much hard work for them to do it.

    I had a case in for 11 years and despite the info I gave them it was never acted upon. I ended up withdrawing the claim for maintenance because it really was a total waste of time – just like the agency regardless of whether you are an nrp or pwc.

  3. It could be worth your while to also request a copy of your file from DPU Unit, CSA Newcastle to help with your complaint to find out if the CSA have actually done what they are telling you over the phone.

    CSA Legislation has not previously covered having one amount offset from another. Under what grounds did the agency have the ability to do this?
