Problems with CSA arrears

Hi, I’ve been paying by direct maintenance since 07/2005 but now the ‘ex’ wants to get the CSA involved. So have received letter from CSA asking for 2 months payslips plus direct debit form. But when I called the CSA, the case worker now also wants to charge me £1034 due to some mistake they made in suspending the ex’s deductions between 1/9/2005 & 2/2/2006 while she was claiming benefits! The case worker is saying that it’s a secretary of state decision at that time and after that time all money would go to the ‘ex’ anyway, plus caseworker is emotionally blackmailing saying ‘to keep your child happy’.

So for example if I was paying the CSA £49 then they would have only paid the ‘ex’ £9 – but I’ve always paid directly into the ‘ex’s’ account, without CSA’s involvement…does not make sense! They want to take 3 monthly pymts to cover the £1034!!! Please please advise.

  1. Hi, Technically your Ex has been paid twice, by you and again by the CSA. I would advise that once the CSA became involved you should have withheld the payments to your Ex until the CSA requested the payments from you. Then pay them all the monies due.
    Quite possibly as you Ex has been payed, she should owe the arrears to the CSA.
