Paying CSA with four children on file 3

Me and my husband have been together 10 years and he had a daughter with his previous partner. They split when she was 1 half years and she went to the CSA they was takeing £280 per month then she asked him to pay her £20 per week cash in hand he said no so she stopped him seeing his daughter.

We then got together and got married and went on to have four children. Firstly in 2007 we was told by the CSA we didnt have to pay nothing because my husbands wages would leave him short she appealed and a load of letters were sent back and forth (these letters can not been found so the CSA say). my husband then got made redundant and was out of work for 6 months. he then got a new job and started paying CSA £210 per month.

We have now just been told that on his calculations he only has 3 children and they was informed buy myself in 2008 that another child had been born we cannot claim none of this money back because they cant find no letter or phone call on there system stating this. we have been over paying a strain on our marriage at there fault. The way they speak to you is disgusting.

We have had 10 years of hell with them

  1. Tammy,

Did you contact the agency by phone or letter?

Is your OH child support calculated under old rules (before 03/03/03) or new rules (on/after 03/03/03)?

  2. They can’t ignore child benefit dates which I’m sure you can prove your claiming with the 4 th child, I had this with the csa saying we didn’t inform them of my children, why wouldnt I is what I told them and they took my child benefit number and back dated us….don’t just take their word, keep complaining and send letters recorded.

  3. hes under the old rules and all contact was made by phone by complaint was sent in letter and recorded.. They take the piss big time.. I dont know why some mothers go to the CSA cause they are horrible people Id never go to them.. Battle is still on going

  4. Tammy,

Im not sure if the CSA have to act on information given by the NRPP, unless the NRP has informed the agency that they will be acting as there representative. I’ve got a copy of CSA guides and will confirm this for you.

It may be worth your OH applying for his Data Protection File, although it would cost £10, he would be able to see if your conversation was noted by them. If it wasn’t then I don’t think you’ll get much joy from complaining.

  5. The CSA only recognise 3 children living with the nrp, if you look on the csa calculator it asks how many other children, 1,2, 3 or more 🙁 It sounds as though you have the authority to act on hubbys behalf but a 4th child will make no difference. Ridiculous isnt it!!
