Partner faces demands for arrears going back 20 years

Please my partner has been contacted by letter from the csa demanding arrears after more than twenty years.

The two children are now thirty years of age. And is the ex spouse that must claim for the arrears.

When he contacted her she said she knew nothing about the siutation. So he thinking that the csa did it on his own.

Please give me some guidence and advice

    Did your OH pay CS to his ex for their children?

    Was your OH aware the CSA were involved?

    Did your OH’s ex claim benefits? (If so, arrears may be owed to the Secretary of State)

    Have the CSA had all the info they require to make a proper calculation OR is the case subjected to a penalty assessment? (This could possibly be altered to a proper assessment, and may reduce arrears)

    The effective date for a case to commence is once the agency have made contact with the non resident parent. You really need to establish when and how the agency consider they have done this.

    Your OH should apply for his Data Protection file and a complete account breakdown, the agency have 40 days to supply such and there is a fee of £10. This should supply him with all the info the agency hold on him and enable him to establish if the alleged arrears are correct.

We had the same issue, csa wanted arrears from 15 years ago…we asked for a break down, never had it, go and see your mp and start writing letters to demand how these arrears came about and why it has taken so long to contact you. In our case it turned out my husband owed nothing on the 13, 000 they were demanding and taking money via deo, which has now been cancelled and now we are trying to fight to get the overpayment back which they said went to the pwc, which it hasn’t. If you think something is wrong, then go by your gut and fight them. Good luck
