Old rules to new Phasing

I am a non-resident parent, a term I truly hate. I separated from my wife with whom I have a daughter amicably and we had a private agreement regarding child support payments. Later I then fathered a child with a girl that I was briefly with, who put a claim in with the CSA as is her entitlement, no problem so far…….

That initial claim was in the old rules that would not recognise the on-going private agreement therefore my ex-wife then placed a claim with the CSA in order for child support for my daughter to be recognised. This was placed into the new rules and a new combined assessment was made bringing the claim from the old rules into new rules format…..still no problem.

A few years later I remarried and had a daughter with my wife, all along a had paid every amount requested by the CSA , informing them of all changes in income and never missed a payment. I later had a another child with my wife and again informed the CSA of a change in circumstances, still making all payments requested which had been equally split between the mothers of both children…..then the problem occurred.

The CSA rang me up and stated they had made a mistake and had not applied phasing to the old rules claim when it was transferred into the new rules system and that I owed £13,500 in arrears!! They asked for a credit card payment which I couldn’t provide and immediately sent a deduction from earnings form to my employer. I contacted my MP who wrote a letter and I complained in writing and on the phone, the cumulative result being I received a letter and a cheque for my trouble for £250.

They result is that my eldest child not gets less than the second born and my family and I struggle with the payment. I am told that it doesn’t matter that they did not recognise the error for over 5 years. I am told that the sudden increase in my payment isn’t applicable to be phased in and i am told that there is nothing i can do as legislation covers the CSA for making mistakes. What annoys me most is that I have to complain to the CSA, not to an independent body so they continue to stonewall me.

HI Adrian, this new phasing did similar to me, my ex played the system for years, paying when he wanted and what he wanted, then eventually after years of complaints, appeals, etc. and winning, they decided to take action (i.e. prison) against him, then new phasing came in and in the meantime he had a child by someone else (who already had a child) was on benefits, never worked, didnt want to work, etc. whilst I was and always worked. So half of what I was owed ( approx. £20) went to her! Both my children suffered due to this and I can not see how far this is that she ended up with more for one child than I ever did for my two! Dont know how this can be justified.

  2. Wow!! You must be really proud of yourself to get him sent to prison well done! Bet your kids grow up to really respect you!
    Phasing is the worst piece of legislation. I can see from both sides of the coin I have been a single parent dealing with the CSA and the wife of a nrp being completely screwed by the CSA. In my opinion the CSA don’t care about anyone as long as they’re getting money in and the only way they get the money in is by screwing over the decent guys because they are willing to pay they constantly falsifying records creating phantom arrears for the dad’s that don’t run away that want to pay! The CSA destroy these dad’s destroy their relationships with their children they almost always get a doe on these poor guys that after are left hopeless unable to buy food or pay bills.
    So I can see why so many men dodge the CSA and go abroad because if they don’t for 19, years or so they are on the poverty line!, If they do overtime to try and pay bills or get car repaired 20% tax and 15-20% CSA and they do take it.
    I have been fighting the CSA for 11 years for my husband and I am pleased to say I have won got 3000 over payment back compensation also won a court case taking them to court for screwing my husband over for 28000 when his ex and child were living in Spain got it all back!
    I will pursue every CSA hell page and every forum for nrp and advise them how to beat the CSA fairly and with the correct procedure!
    There is barely any help for them that is free so if I can help I will!
    Someone has to put a stop to these scrounging women using the CSA to bleed their ex dry want money get a better job!!
    And it’s always the women that are jelouse to death that the guy is moving on with a new partner having holiday or a new car and why not!.
    Of course you do get the idiots that don’t give a toss and yes they should be dealt with but NEVER by prison or having their house sold by the CSA and given to the mum to squander!
    I relish the fact that mum’s will be imprisoned for the abuse to their child for not allowing them a relationship with their dad!
    Abuse me do what you will we won and I will help other nrp win also I don’t care about PWC opinion or abuse anymore we were broke for 11,years my son had nothing because all our money was given to PWC to live it up in Spain no more!!

  3. could not agree with you more, story is too long to tell , however I have spent my savings to enable my husband pay the the csa ,because I own my home,
