My kids want my surname and not their missing father’s – what can I do?
Hiya dont know if you can help me with this i have two children and i spilt from there dad 4 years ago he does not see them and he dont pay anything for them i dont know where he lives we were not married but the children have his surname,my children are age 9 and 8 they keep asking me if they can have my name so we all have the same name they never ask about him at all and i just wanted some advice about this.

Hi, changing their name would depend on whether their father is on their birth certificates. If his name is not on them you can go straight to deed pol and change them that way, as this is what I did with my daughter. If his name is on their certificates I think you have to go to the courts to change their surnames as you would need his permission to do it via deed pol.
Deed Poll
you can go via deed poll but he can demand it be changed back if he does he could take you to court to do so. If you want it done legally and so it cant be changed back go to the court and get it done legally through them the only problem with that is he will also be informed of the court action and may attend himself to stop it. Ultimatelly it will come down to whats right for the child and most times the court will find in favour of het father saying the children have a right to identify with him as your childrena re 9 and 8 teihr opinions aren’t likely to be worth anything to the courts
