If she ain’t claiming child benefit then you shouldn’t be paying maintenance. Is as simple as that
if the mother isnt claiming child benefit then you should not be paying money to csa
Contact child benefit and get them to forward a letter on to the csa stating that the child is no longer in receipt of child benefit and the date it ceased , they will then have to give u back any monies u have paid since child benefit ended because u shouldn’t b payin once it’s ended
No cb no maintenance thems are the rules
Are you paying through mutual agreement or csa?
Csa will look at seeing if child benefit is still being paid which then makes you liable for child support, if it isn’t then no maintenance needs to be given.
Stop giving the ex money and find out how long you have been overpaying.
If she works more than 24 hrs a week or is only in part time further education or mother nolonger gets CB or all the above csa stops but you will have great difficulty claiming any over payments back. The nasty csa may suddenly claim you are paying off made up arrears that dont exsist and wont and dont provide evidence but good luck anyway
