My daughter has lived with her mother for two years – why do I have to pay suddenly?

Ihave just recieved a phone call from the CSA my ex partner has put a claim in against me for maintenence. I am liable to pay from today’s date.

My grievence is that for 13 years my daughter lived with me and I never claimed CSA against her and now my daughter is living with her for 2 years now she has decided to make a claim.

I told the lady from CSA this imformation and she told me it did not matter who lived with who and when. I need to know if this is true as it is totally wrong and I feel cheated by the system.

  1. Im sure if our case can be pulled up 10 years later u can make a claim against her for arrears

    unfortunately yes this is right, my case is exactly the same as yours, my son moved to his dads at the age of 14, (he will be 16 this year) then In august I got a call saying his dad is putting a claim against me, even tough he has never paid a penny to contribute to our son!! And they said exactly the same!!

    I believe the point the OP was trying to make was all about FAIRNESS!!!! NOT that he doesn’t want to support his child!!!

    If he chose not to claim for his daught while she was living with him then I can respect his position when he asks why the mother can’t pay for the daughter without using the CSA the way he did – he sounds like a decent man and father!!!

    @ Andrew – i’m afraid that’s the rules… regardless of what you have paid for your daughter for the last 13 years, the scum CSA staff (and some pathetic females on here) will tell you that it was your choice not to claim and that the mother has every right to claim (as you did when your daughter lived with you)…. it’s a shame the mother can’t be as decent as you were but some people just can’t help but see the £££ :'(… good luck!!
