Mother says I am not the father, CSA says PAY UP!

Hi all! my name is Terry but my real friends call me Tel. i really need your help/ or anybody else out there that can help me!! AND FAST!!
The CSA are stopping 40% from my wages (attachment of earnings) this starts 26th Aug 2010. i am a low wage earner NET MONTHLY income £979 amonth, i have a morgtage of £550 amonth, i Pay council tax through deduction of earnings as i’ve been made redundant several times & I pay for other living costs etc… I’m also in arrears with the morgtage supplier and they have denied my request to lower my monthly morgtage repayments. if the CSA countinue these deductions i will become HOMELESS.I’ve been battling with the CSA since Mar 2005. AT NO POINT WAS I TOLD I WAS A FATHER!! I recieved a letter in Mar 2005 stating that ” the CSA had phoned me, & i told them that i was the father of a boy called…. born….”. I visited my local C.A.B. they complained on my behalf. The CSA replyed, because they didn’t receive the very first inqury forms, they can apparantly ( sent Feb 2005 ) presume parantage.

I STILL, TO THIS DAY I DISPUTE THIS.

I never received these forms. The CSA also stated that they had in there persession a birth certificate with my name on. Which was not true!! They are/ were very lax in getting in touch with me!! when they write to me, they say i’m at fault for not answering or replying to any of there calls or getting in contact with them… i can not afford a BT land line. I ( like many ) use a mobile phone, which costs an absolute fortune when you call the CSA. I gave up calling them as i never got through, always to busy, always in a queue. i agreed to a DNA test ( i agreed to pay as well!) The CSA replyed back ( 3 months after the agreement ) that they were having trouble contacting the boy’s Mother…

IT WENT QUITE – just under Two years later i had a knock at my door, a little Muslim lady told me she was from the CSA, she demanded i hand over 2 wage slips and if didn’t it was a criminal offence, i was also told i’ll have my property seized. I’ve tried contacting the Boy’s Mother, She still thinks i’m not the father, she has also told me to keep away as it is confusing the boy ( who’s nearly 9 yrs old) if i didn’t they would call the Police. I would like to point out that i’m a caretaker of a school!! i still believe the CSA delibratley MISS LAY/ DON’T SEND VERY IMPORTANT FORMS (LIFE CHANGING FORMS) – THIS CAN BE ALL AVOIDED IF THEY USED REGISTERED POST, WHERE YOU SIGN FOR A LETTER.

Again last year i was summond to court for non-payment… i never received the summons!! The CSA make it look like i’ve been ignoring them!! my Parents can not afford to help me. I REALLY NEED HELP PLEASE.

    Have you had the DNA test done yet?

    If you are not on the Birth Certificate and you request this then as far as I am aware they should not deduct any money from you until it is proved you are the father. However if you are on the Birth Certificate as they claim, then they can, in fact they can even then refuse you a DNA test.

    You say they have stated you are on the Birth Certificate. You calim that you are not, and to be hobest you should know as you would have had to be present at the registration as you were not marries to the mother (or were you?).

    The first thing you need to to is get the evidence to prove you are not on the Birth Certificate. You can get his online for anout £10, make sure you use the official Government web site as others will charge you more.

    Once you have the proof you can then demand the DNA test and that they stop payments in the meantime. Give them 14 days to acknowledge and effect this or you will make a County Court application for the return of all money taken from you. You can do this via the moneyclaim online system.

    Did you write to the Court advising that you had not received the notification and asking for any judgement to be set aside?

    Apply for your Data Protection File asap – there’s at template letter in the download section at http://www.afairercsaforall.co.uk (The agency now charge £10 for this, DO NOT send a cheque or cash. Postal orders should be payable to the; CSA)

    Once in receipt you will be able to establish what address the agency sent their forms to – If it was not an address you have ever been associated with, then there will be no case.

    Hi, A couple of points, never hand anything over at the door! Doesn't matter who it is!! Always send origionals but make sure you have a photocopy of whatever you have sent, best to send recorded delivery if you can, I know it's expensive but it will help if it comes to going down the legal stages, always keep all receipts or transactions. Honestly we have been through a tough time with the CSA recently and I can understand the frustration you are going through, we have had situations where the CSA have claimed to have sent letters to us but we have never recieved them which have then made us owe them more money. Please keep a close eye on the dates of the letters being sent – we have had letters being back dated from the date that they were actually sent to us! The only thing that might help is having that DNA test. While this is being done they shouldn't be asking you for any money until it is proved that you are the father! Also it's worth asking them to send a copy of the birth certificate that they hold for you. If you are the father on the certificate then you have the right to have a copy.but please be warned if you are the father then you will have to pay what is owed. we have recently be told by the CSA that their money that needs to be paid back tops all other payments to anyone else, i.e rent/morgage council tax etc, and that if we were having difficulties paying we should speak to a financial advisor. Kind of them!! Hope you somehow sort this out, we couldn't!

    I'm an advisor at the CAB and work there on occasions voluntarily. You can stop this DOE. your entitled to legal aid and certainly legal help. Go and see a lawyer, use the internet to find not just any tom dick and harry lawyer but one who specialises in benefits and welfare issues and they can deal with CSA issues. Move your arse quickly! dont let them get away with it otherwise they will walk over you. They can be beaten, trust me been there and done it. People forget they have a local MP, they are there to serve the public and i have used mine and she was extremely helpful, they are obliged to help you because they want your vote and when they write letters beleive me it does carry weight.
