Mistake after mistake made by the CSA
I’ve unsuccessfully been involved with the CSA since July 2008. Sadly, during my 5 year ordeal I’ve had to formally complain the CSA and my local MP, but no resolution has been found. Instead my file is passed from one department to another all providing me with different information. I am often promised a return call within 48hrs, only to wait weeks for no response.
My ex-partner is a director, shareholder and owner of various Residential Care Homes, management and letting of personally owned properties in the UK and abroad. His mortgage is £2400 per month; however he claims to be earning £924 per month.
The CSA has made mistake after mistake, passed my file around like a hot brick and 5 years down the line the CSA has done nothing to collect the maintenance arrears, nothing to enforce payments are made to them directly and failed to calculate a payment schedule repeatedly. I’ve become accustomed to my case being left in a pile, sometimes taking months to appoint a caseworker. In August 2008 my case was archived for absolutely no reason.
I am dependant on this income as I look after my 4 yr. old with mental and physical disabilities on a daily basis. I have spent significantly more money phoning the CSA on 0845 numbers than what I’ve received in maintenance. I am tired of constantly supplying the same information for no reason.
Has anyone ever taken the CSA to court for emotional abuse, depletion, deliberate distress and ruining a person’s life?

I know that there was a court action against the CSA in the past but the Court decided that the CSA did not have a duty of care to either the children they collect for or the parent with care involved. Here is a link to the article that a Ms Rowley brought against the Agency for their failures

Unfortunately your case is very similar to alot of other cases. I for one had a case in the system for 11 years, never received a penny maintenance. Like yourself I would constantly phone them, provide them with information but nothing was ever done. I eventually withdrew my claim because it became a total joke.
