Loophole in the CSA
My local CSA claims my ex-wife is not using a “loophole” but let me know what you think.
Our divorce was a year and a half ago, even though she married another man during the divorce. Her husband did not attend the divorce hearing with her so I assume he didn’t know it was still going on since she told their pastor who married them she was already divorced. The judge granted me custody of our two kids (she now has racked up 6 counts of negligence and has two other kids with different fathers in adoptive homes in CA)and ordered the minimum child support which she agreed on record as able to pay. In the time since then We have received one payment from CS which was tax intercepted from her “husbands” income tax and did not even cover half of what was owed at that time. She is now over $6000 in arrears, has a bench warrant in CA, may have another child on the way, and my local CSA, CA CSA, and child services cannot locate her now.
My local CSA sends me demeaning emails in response to my update requests claiming they are doing all they can but jurisdiction, no work history, and locating problems make so they can’t do any more. I have given them info, family contacts, etc to find her but in nearly a year they have had no progress. Before the negligence charges, my ex had the kids and I was the one with the support order, I paid as I could but had a period that I couldn’t pay. Within one week, I had the sheriff’s office at my door serving court summons, I had her family calling me threatening me, she was demanding money. Now the tides are turned and I only get responses of “Oh that’s terrible, just do what you can to provide a good life for the kids” and “She has nothing the government can seize, so there’s nothing they can do”, Nothing they can do? That’s why there are so many MEN in jail right now for back child support? Any woman, including my ex, who has had problems getting child support I have known stirs the bees nest when support is at stake. Police track down the dad, summons are issued, legal action in the works.
What happens when I tell the agencies and police? They send a letter to her last known address then shake their heads when there is no response. It is sexist, I was even told by a CSA worker “The Child Support Network was originally set up to make sure that during the wars, women were able to support their families while the men were away” That’s an interesting fact but I was told this while reporting the failure to pay. I am tired of the “that’s how it is” responses and “We’re doing all we can” when if it was reversed I would be in jail. The fact that I can provide for the kids on my own is not relevent, it is the fact that a court order is not being enforced when requested, in fact I was discouraged from seeking advice or help along the way by both agencies and family.
She has found a loophole, it’s that she has found a way to make it difficult and expensive enough that the agencies won’t pursue her, it’s just too hard and expensive for the government to enforce this order.

There are a lot of fathers out there also who are getting away without pay CS. To understand how the child-support system works you need to look at the CS feeding chain. And it goes like this. First on the list is the Government. Then come custadorial parents, then the non custadorial parents and last on the list are children. Yep the kids!
The most important thing is that governments protect their own coffers. Governments will do almost anything to avoid paying 1 cent to help support children. If the parent with custody goes on welfare the government will hit up the non-custadorial parent for the money like a ton of bricks to get as much out of them as possible.
If the parent with custody is NOT on welfare and the non custardorial parent doesn’t pay up, the gov’t doesn’t care. Why spend tax payers money chasing them ? What does the gov’t achieve by chasing and catching them? It achieves nothing but lost revenue.
So, if you want the gov’t to collect from your ex the only way that you’ll get them to help is give up your job and go on welfare. Then they’ll chase her down like a dog.
Now you ask about the kids. Always remember that the friends of the court are the friends of the gov’t – not the family. The kids really do come last.
Always remember the CS system is here to protect the government. They don’t care about the parents or the children.
