Lesbian mother licks CSA
A lesbian mother has defeated the Child Support Agency in court after they made her pay a greater amount of child support than if she was in a relationship with a man.
The woman, who is known only as JM, won damages of £2,550 plus £15,275 after she took her case to the European Court of Human Rights.
JM was granted a divorce from her husband, who took custody of their two children, and set up home with her new female Partner. She was required to pay £47 per week to support her children, but asked for a lower rate of payment which can apply to mothers and fathers beginning a new relationship.
However, she was not granted it on the grounds that she was not in a heterosexual relationship. If she had embarked on a relationship with another man, she would only be required to contribute £14 every week.
She took the matter to three different courts, where it was upheld until an overruling in 2006 by the House of Lords.
The Court of European Rights stated:
“JM could compare her situation to that of an absent parent who had formed a new relationship with a person of the opposite sex. The only point of difference between her and such persons was her sexual orientation.”
“Therefore, her maintenance obligation towards her children had been assessed differently on account of the nature of her new relationship.”
“Yet, bearing in mind the purpose of the domestic regulations, which was to avoid placing an excessive financial burden on the absent parent in their new circumstances, the court could see no reason for such difference in treatment.”

The CSA couldn’t care less about a new relationship!! all they want is money money money….oh, and just in case you weren’t aware of it….more money!!
Maybe this was an April Fool story submitted very late!!
I agree the CSA are thieves, I have a son from whom UI co parent with two lesbian civil partners. The agreement before my son was conceived (through artificial insemination) was that the three of us i.e myself and my sons birth and non birth mother would all have a financial responsibility for my son.
However following a break down in the relationship after many false accusations I informed my son’s birth and non birth mother that I would not be assisting them to conceive another child as i felt that it would be irresponsible to bring another child into an environment fraught with conflict.
As a result of this they decided to use my son as a weapon against me by cuuting any contact my son has with his paternal family and grandparents. This resulted in myself pursuing a legal battle. Although I continued to make maintenence payments for my son each month via bank transfer. my son’s birth mother declined my payments and returend them back to my bank account. Following this she then proceeded to identify me to the CSA as my son ‘s legal parent. Although I have no legal say in my child’s upbringing, health matters or education as I was never named on his birth certificate and do not have Parental Responsibility for him. However My son’s birth birth mothers civil partner has PR for my son and by law is allowed to be present at mediation and at court, but from the CSA’s perspective she has no financial responsibilty for my son.
The issue here is not the maintence that I am required to pay for my son, as i have my pride and wish to contribute to his upbringing. the issue is how I as his legal parent as idenyfie by the CSA have no legal say as far as the law is concerned in my sons welfare unless it is financially. Yet someone who has no financial repsonsibilty for my son has more say in my sons wellbeing and upbringing. Where is the Justice in that?
