Is there any way to reclaim the money the CSA falsely took?
I have recently found out that my daughter had been kicked out of home by my ex wife when she was 16 . I contested the csa decision to take payments from me , as part of my divorce settlement was that if I did not contest the divorce and provided for my kids out f my own pocket she would not involve the CSA.
She remarried a couple of weeks after the divorce and soon after I started getting letters from the Csa demanding payments . I informed them of the divorce agreement and was told it wasn’t worth the paper it was written on!!!
When I told them it was passed in a court of law , I was told “they were the law” and if I didn’t pay I would be imprisoned ! I contested this for five years , until they finally took me to court and got a detachment of earnings , taking 40% of my wages .
During this time I lost contact with my children , because of the problems it caused with my ex and her husband . I hadn’t seen my kids for 5 years, my daughter now 21 and my son 27 , and was told by my daughter she had not lived at home since she was 16.
I have payed nearly £20.000 , th total arrears being over £21000. My daughter has been claiming benefits since she was 16 and received no financial support from my ex , yet when I informed the csa , they told me that because I had not told them at the time they wouldn’t do anything . When I pointed out there rule that states my ex wife should have informed them my daughter had left home I was ignored.
They are still takin payments and have told me , if I don’t pay , I will be arrested and imprisoned . I am in debt and living in temporary accommodation , is there anything I can do to reclaim the money I have paid?

Take it to your local MP hun be your best bet .

We never got our overpayment back either because csa says it was deemed correct at the time, even mp couldn’t get his head around that one! I have a funny feeling the pwc was ordered to pay it back because she took the csa to tribunal with my husband being 2nd respondent and lost.
In the op case, if child benefit was being paid to the pwc then child maintenance is still enforceable. Did you inform child benefit of fraud and can you prove that daughter moved out at 16 as evidence? See your mp, but I doubt very much you’ll get your money back. Best of luck.
