Having just received my 2nd report after a 14mth and having just been scraped down from the ceiling i find a catalogue of contridictions.
Debt is £41,500 and this grows every week £100.37, various liabilities orders and ex husbands property is charged up to the hilt!
The closing statement from ICE is as follows: I QUOTE ‘ it’s not the CSA’s fault it’s Mr W’s willful, persistance and reprehensible conduct that has led you to be without full maintenance, they do not attibute your adverse health effects to inaction on the part of the CSA but to Mr.W’s failure to pay child maintenance to me at the rate he has been assessed as being able to pay and when it was due to be paid by him!’
Funny i thought the CSA were there to get maintenance, but then when there isn’t any legislation in place to make an absent parent pay maintenance, but yet they advise the CSA to make a consolatory payment of £150 for mal administration, they are either responsible for the huge debt or not for actively encouraging my ex husband to not pay over the past 14 years!

The CSA are there to assess and enforce Child Maintenance if required.
The only have a range of measures given to them under law to forcibly take money from the NRP, once they are exhausted they can only secure the debt against againt his home for future realisation. They appear to have done this.
If you wish him to be evicted and the house sold to pay you, you will need approach your MP to change the law.

I cant comment on the response you have received from ICE, as I am unaware what was in your correspondence to them…
However, once your case no longer has any qualifying children which your ex is liable for, and a final charging order has been granted and registered, the agency can then apply to the court for an order for sale.

The CSA are refusing and have refused to force a sale on the property. Bailiffs visit and bailiffs take there chunk first as payment for their visit before i see any monies, although i have had debt payments via the bailiffs but this isn’t consistent or reliable.
The debt is being paid via a suspended sentence and a suspended removal of driving licence. The CSA court presenting officer believes that my ex husband is completely within his rights to take 50 years to clear this. My children will be 67 & 69 years old by the time this debt is cleared. That is calculated on the debt as it stands to date and future date until both my sons reach the age of 18 and are out of full time education, not exactly the 2 year criteria they insist other NRP’s should repay debt.
Brokenfather, thank you for your comment but sadly we have a grave loophole that not one Politician will address with me (David Cameron, Helen Johnson, James Clappison, Theresa May, Alan Johnson & Iain Duncan-Smith) and that is there isn’t a law to make an absent parent pay maintenance, and what makes it worse is my children’s father is self employed.
I pay csa every week and so far I have lost my house and have had my water cut of and have gone without food for 3 days all thanks to the csa and still have to fight to see my kids

The court sets an amount that should paid at the time they suspend either a prison sentence OR removal of driving licence and not the CSA.
The agency will refuse to press for sale of the property at this time, as the case still has a qualifying child that your ex is currently liable for. As before, once ALL qualifying children no longer qualify, and the CSA have obtained and registered a FINAL charging order for the funds owed, the agency are then in a position to apply to court for an order of sale.
Hopefully the amount owed is correct – However you should be aware, if the figure is based on a penalty assessment, etc, the agency should rectify such if your ex can provide the necessary information, which may decrease the amount.

The court didn’t set the amount, he said i’ll pay £50 per month per enforcement action equalling £100, they didn’t even look into his accounts they took his word for it that that was all he could afford to pay! and this money hits my account at sporadic times of the month they have never had a date carved in stone as to when he is to pay by, one month i can get two payments other months i get nothing, and apparently i am to be grateful for this money.
I believe had a judge been armed with the full extent of the debt and the fact he refuses to pay maintenance they may have been proactive in investigating his accounts and not agreeing to what he offered, he offered the minimum amount as this shows willing in clearing the debt over the next 50 years

i wish my ex husband fought to see his children, not bothered in 7 years and my youngest was 16 yesterday and not even so much as a bag of crisps from his Dad. Strange really that enforcement is tough for some and not others who owe huge amounts of debt!
I think we should colaborate and approach watchdog, what do you think..
for gods sake lets do something its obvious what they are doing.Lets stop being against each other thats how they win.Parents with care and nrps lets all agree the agency is corrupt and its the goverment that guides them.They are destroying families for profit.What are your children worth to you? Not even a monthly letter to you MP or news paper !!! Then you have yourself to blame.It wont be easy but for your childrens sake do it.
It's perfectly obvious that this agency has failed, and continues to do so. So many times it has been branded ''Not fit for purpose'' yet all the government does is change the system, buy new computers..then watch it fail again!
Wayne i have requested meeting with Ian Duncan Smith, Helen Goodman, David Cameron (Spoken to him directly!) yea had a breakdown too bringing my daughter up as a single parent. Money is tight. Oh…I didn´t get any ´maintainance´or help from the state at all. Nothing.
I would be very keen to look into it lisa,I will look into how it works with the watchdog thing as Im sure there are guidelines etc and I'll get back to you,

Count me in for a protest i too have sent an email to watchdog. i also have a damming recording with Robyn lullham CSA Hastings where he admits its ok to claim disability fraudulently just as my ex did, to avoid csa. apparently there is nothing the CSA can do even when you prove to them benefit fraud has been commited. If you dont want to help a benefit cheat then dont hire a skip from Johnsons Skip Hire in Stafford.

the part about having a protest is pointless as we are spread too far apart and many of us could not get to a protest ,so on the day it looks like only a small number are protesting which renders it un news worthy. However the watchdog or panorama route may work.For some reason they seem unwilling or afraid to take on the agency but lets give it another go.Government cannot destroy us and our children just for profit!Any links would be great
