I’m now employed by my ex but it’s causing problems – what can I do?

Hi,

After being self employed my partner setup a limited company for whom I now work. I am the sole employee and my ex wife is appealing the CSA desision as I am only paid £7.45/hr. She argues that the company is mine, even though I am not a director and simply an employee.

The ex says that as I am the only employee is am effectively self employed and any money the business charges should be classed as my earnings.

I am really concerned about this and wondered if you had any experaince or similar cases.

  1. Piss her off even more, and become self employed yourself!
    That way, you will ‘on paper’ earn even less, and actually pay less tax, and have more in your pocket.
    It’s what I do! Best decision you’ll ever make!

  2. aslong as your partner pays tax on her dividend and IR receive the proper tax returns I doubt there’s anything she or the CSA can do

  3. After the original post back in July 13 I have received a court date for a hearing. Apparently, I am diverting income because I am the sole employee of the business. I dont see how I can be classed as doing this when my employer who is my partner has taken no dividen or PAYE.

    The total rubish that has been alledge is that based on my income I should not be able to afford a holiday, car or presents for my children at christmas/birthdays.

    I am fighting this with a leading solicitor who specialises in CSA matters but even they beleive the ExWife may have a valid claim. I am beginning to wonder whether I should save the £10k solicitor/barrister cost and just give it to my kids

    I will post again when I have results from court.

  4. Sorry, it needs to be clear that I am NOT employed by my ex-wife. It is my new girlfriend who I work for and the ex-wife is claiming that I am diverting income!!

  6. Its almost 12 months since I added the original post. Since then I have spent £9k on solicitors. No more!

    It seams that my ex has used pictures from facebook siting that I own numerous vehicles, motorbikes and have many holidays. I am so glad I have no photo’s on there of me on a plane, bus or train or it would be alleged I own them too. I am not Richard Branson!

    I still do not have a date for the tribunal.

    Until I am left living in a cardboard box with nothing she will continue to try and take everything. The main reason being that if I have no money I would not be able to afford to drive 500miles round trip to see my children.

    If it was me who had the affair I could understand her but it wasn’t!
