Unfortunately child support payments and access are 2 different things and are kept separate. The first question is, were you married? because if you were all debts are “jointly and severally” which means that they are payable by either one of you, if she defaults, you have to pay them and vice versa.

As for getting the CSA off your back, forget that idea, all you are able to do is limit the damage that they inflict. Firstly, forget about having a good credit rating, that is going to be just a dream now, your credit rating is going to go through the floor, but all is not lost, you can rebuild it, as after 6 Years you can rebuild it again. NEVER allow the CSA to have payment via Direct Debit, as they will empty your bank account, use either a Standing Order or set up another account specifically to pay the CSA, and just transfer enough money to meet the payments……… There is another course of action, but I do not advise or condone unless the situation is drastic, you may have to lose your job and either become sick or unemployed as the maximum amount you will have to pay will be £5 per week out of your benefits and £1 towards any arrears, which they will conveniently create
Are you still paying the mortgage now? Csa should offset this against any maintenance payments or tell her that she will have to take it over but you must get legal advice.
She has no right to stop you ftom seeing the kids unless there is abuse so get a contact order asap.
If csa fail to listen then see your mp and tell them exactly what is going on with your case.

Go to the cab citizens advice bureau. Ask them about a civil law suit as you are looking to claim back all monies paid over and above the csa amount. Write her a letter of intent outlining your demands and reasons why and set a date to your demands if she then pays not attention to your letter you can start the process to sue her
C.A.B as useless they are Stake holders of the CSA, and therefore support the CSA
Civil law suit will have to be considered separate from.any csa money being paid.
In Civil Law you have to prove a debt has occurred, on the balance of probabilities, if you agreed to pay half mortgage and to buy car, you have no case

i am in the same boat csa take £105 (£32 arrears)0f my £380 take home pay for one child I am now married with four kids to bring up on whats left .had some one from csa ring me today to ask if I could pay my £600 arrears off funny thing is my csa has allways been payed by court order so how can I have arrears? csa can not answer
If you pay half a mortgage for a home she lives in, you may be able to apply for a “variation”. Call CSA and ask about this as it may reduce your payments.
Someone above mentioned the CSA emptying a bank account if you pay by direct debit. Under the direct debit guarantee, if any company takes a different amount than agreed on your direct debit schedule, you can ask for a full and immediate refund from your bank. This doesn’t mean the money isn’t owed or will disappear but it gives you a chance to sort out any grievance with the company.
Lastly, if you currently pay arrears then you may be able to negotiate the amount you pay. The best thing is to call and explain your circumstances to see if there is any give and take.
