I’m about to lose my house because of the CSA but they don’t care
April 15, 2013
My ex partner emptied the home of 100% of the property, including my clothes. She left me with £8,000 of debt. My basic income is £1741, my outgoings are £1926, so i do overtime to survive.
The CSA have quoted £900 a month to recover arrears, told them i wont do any more overtime, they say they will still take £900 till i give 3 months of wage slips, so i am left with £800, to cover 600 mortgage, 250 fuel, 100 gas electric etc, see my point? I am at risk of losing the house as I’m in 4 months mortgage arrears, and all they say is we don’t give financial advice.

If they haven’t given you a. Liability order they have no case, write to. Your mp asap butits typical csa scum scare tactics , but. Act fast
@CSAHell the judge told me in the same situation .. Wasn’t his problem
The government, judiciary and civil servants are all in this together, it’s totalitarianism.
If you are getting ‘stitched up like a kipper’ by them all, remember that you have every right to use the law as they do, so when you the government/local council require your vote or you get canvassed at the door by prospective councillors, politicians representing themselves……..report them to the police for harassment, because I am sure that you will be alarmed and distressed, given the way you are being treated by the hierarchy. (the key elements of harassment).
Go to your M.P. They are there to represent you, even if they are in on the scam, and ask them why you are being demonised and criminalised regarding your children! Not the governments children, not the mothers child your children!
The absolute MAX they ca take is 40% of your NET income, regardless of how much the alleged arrears are.
With the £8k debt, what was the debt for?
UPDATE:- I challenged the CSA in court, and argued that they didn’t take into account the £8000 debt that the wife took out on my credit card prior to leaving, she admitted she spent the money on the boys. So I used that the debt was for the benefit of the children and that the fact CSA was set up for the benefit of children not the parents, and as their request would have a negative effect on her children their request was unreasonable. Although the courts have no jurisdiction over the CSA their request would damage my mental health, my physical health, my relationship with my children and my ability to rebuild my life which in turn includes the children, The Judge ordered the ex wife repay the £8000 and set the child maintenance at £250 a month. A brilliant result, the mortgage arrears and other debts have been cleared and the relationship between my children and I continues to Flourish, must to my ex’s dissatisfaction. It goes to show, although its was the ex who had the affair and attempted to destroy me, staying strong and positive will keep you good.
They are doing exactly the same to me but with a Liability Order in process but I rent my home from the Council. As a result I will have to file for bankruptcy after 10 years of sorting my life out and just getting to the stage where I can almost pay all the bills. I am disabled so limited as to the number of hours I can work each week. My ex has a good job a flash car and is currently in the process of purchasing a huge property in the USA where he is intending to live permanently by the end of this year. I cannot afford to keep warm and I eat beans on toast every night! The CSA couldn’t give a f***! I bet they have never been cold or hungry before 🙁
My experience as a mother who had to pay maintenance. Debts incurred as famiy are and can be used in assessment, unfortunately for me I took a loan to pay off these and by doing so could not be included in the assessment by the CSA. I lost my home x 2 40% may be accurate now but CSA siezed my wages, I contacted my MP but CSA unfortunately can say / do what they like and can apparently take your passport / license (handy when you need it to work to pay for the children). One of my children did not live with her dad but I could not prove this other than communicating with her and money did not go to her. Arrears were taken into account even though I had an agreement and paid for £18,000 of debt then had to pay £23,000 additional / 40% of my salary. I would like to think that the money went to the children but on speaking to my son he could not afford to go to university as his dad would not pay the train fare. I’ll say no more but hope some of this helps someone else male or female paying through the CSA.. A further recommendation is no matter what / how friendly the separation is keep records of payments .. otherwise you cannot include them without documented proof.
Will Sterling… Great result for you. Should give other CSA victims some hope.
Mrs Anderson
Depts incurred as family Are and can be used in assessment ….not true….according to Alice.Maybe I read this wrong? Maybe Alice could clarify this for all?
She told me that my depts, that were a direct result from being with my family, ie for home DIY, car purchase, honeymoon etc did not warrant being taken into consideration when applying for a variation.
Her words were ” it was my choice” in other words…my choice I chose to take my wife on a honeymoon ( I’m sure she would have had something to say about that had I chose not to take her on a honeymoon) …lol.
My choice to improve the family home, my choice to marry her,my choice to buy her a car in order to take the kids to school etc etc.
Just like in Alice’s words ” it’s your choice if you choose a job that takes you a long way from home” no thought perhaps that maybe he had NO CHOICE where he was able to get a job…lol.
That said…this poor guys situation is very typical and just proves ONCE AGAIN what arseholes this filth called the CSA really is.
It also show us ONCE AGAIN that the CSA DO NOT give a shit about a father/ mother/child relationship,as it’s quite happy to see a parent homeless and in the gutter….WHERE DOES THAT HELP THE CHILDREN MR FUCKING CSA ?????
Gonk
Well done Will ~ I too have a B & T adulteress ex, who thought that she was going to have everything her own way Not so! The Judge in the divorce court told her to get a job. Shock/Horror for her. Ha!
I’ve survived and getting through it, just getting these CSA ar–holes off my back, is next on the agenda. The divisive CSA have caused rifts by interfering in my private family life. At some stage in the future they will be brought to book over that in the courts!
All CSA victims should stay strong, and get ready for the day when there will be landmark judgements against them, opening the way for ‘restorative justice’!
7 years 37k later and my kids are skint .. yeah CSA look after the children .. Bolx. I am now supporting them… all of them women get it bad too .. oh who gives a..
