If I return to the UK when will preceedings against me start from?
Hi I wonder if anyone has been through the situation I find myself in.
4 years ago I had a one night stand (stupid I know) and the girl decided to go ahead with the birth even though I told her not to I have had to contact for 4 years then the other day a letter from the csa arrived now Iam an expat and dont have to pay and this was stated by the advisor over the phone now I am having a letter from soliciters claiming that she wants an offer on the table before they take me to court??
I am not planning ever on returning to the uk but should i does anyone know if the preceedings will start from my return date or will they try and sting me with arrears back to the initail date of contact

Sounds like a bluff to me, an offer for what ? If it was serious they would specify under what section of the law they were threatening to take you to court and then you could call the CSA and ask them to clarify. There’s also nothing stopping you phoning the solicitor who sent it and asking for clarification and you should get a much better idea about it. They will probably want you to have your own solicitor but just tell them you are “presenting in person” and they are obliged to talk it through with you.

EU countries can only make non-resident parents pay CSA arrears
if the money owed was from when both parents lived in the UK.

RIght for a start they cannot take you to court unless you have a UK address . Remo has to be applied by the pwc not the csa and even then you could appeal any illegal arrears in court!. Personally i think they are putting the threats on you but they have been known to obtain liability orders illegally and if they do you will have to apply to the courts to get it overturned
CSA have a habit of presuming a lot of the time and then they act accordingly, which is illegal, they somehow get away with this as MP’s turn a blind eye, but beware the CSA do not ever let the facts get in the way of a good source of income.

Even though you may not be liable for CSA since you moved, did the CSA become involved before you left the UK and did arrears accrue?
