I look after my granddaughter and neither parents pays CSA what they should

I have a residence order for my grandson. Both his mother and father are liable for maintainance. His father pays £300 pcm and his mother has just set up a new business so her wages are calculated monthly. £39 pcm so far.

She has now spoke to the csa and as they have no cases of both parents been absent, they sugest a fifty fifty split. This now means he pays £150pcm and she pays £20pcm. Hows that for justice???? Win win for both parents. Well done csa.

  1. That really is a bit strange! Why should they only pay half each? They have been assessed on their incomes and that is what they should pay, not reducing it.

    I would write a formal letter of complaint here and take this matter further. This case is maybe out of the ordinary for the CSA and this will cause them a problem but don’t give up for your granddaughters sake.

  2. I think that CSA need to get more indept and carefully look into each individual situation before making A decision ! because I think that they are cheating you , by reducing the amount you are given seeing that both parents are actually working and earning.

    There are thousands of children living with relatives, friends and in children’s home.
    It’s therefore doubtful your case is the only one where both the child’s parents are deemed as non resident and are required to both contribute towards child support.

    It is correct that where there are two NRP’s liability is split, and both the parents pay 50% of the liability calculated based on their income.

    You may be eligible to claim child benefit, child/family tax credits and income support if you meet the criteria and send a copy of the residency order to the above people.   4. It seems very unfair to every nrp who are often struggling to make payments that this grandmother is in this situation and many others. Because both parents have to pay maintenance then it is halved, it seems ludicrous.

    Sorry for my original comment but I do think it is unfair that because a child does not live with either biological parent then their obligation to pay maintenance automatically halves.
