I gave a false DNA test, can I expect to go to prison?
Hi guys, need some advice and.Not be slated!! I have a crown court apperance on the 18 april 2013 for a false DNA test(not the brightest ideas I know), can I expect a prison sentence? because I,m shitting my self I have no previous and have a wonderful new partner And an 18month old and For once my life feels complete, I’ve been assesed for This dna/one night stand mistake at.£52 per week to which I,m appealing against along with the 2 years its taken them to assess so I also have arrears of 6k on this new case.
I’m also not on the birth certificate and don’t Want To be I also want nothing todo with this mistake at all I renounce all rights as father I would like the mistake to be adopted by her new partner! I also have a 22k arrears bill from my first case was. Paying a £100 a month but since the arrival of my daughter can no longer afford this I earn £320 a week take home and after living costs I’m luck. To have 30 quid, I’m so frightend and I’m crying whilst I type this , please help me I feel my world is about to collapse…

I can understand why you did it…..but the courts will only look at facts. Not what your earning or what your life is like now. The fact that you mention crown court would suggest you ain’t getting off with it.. Although prison is a bit drastic I would probably go for tagging where you can still work to pay the useless csa. Pleading guilty will go in your favour as you can bet they have a load of evidence….. Keep us posted on the outcome

Mate the only thing i can suggest is telling the courts as it is, tell them your a father and your child is important to you, how you have told us here, they probably wont sent you to prison, i totally understand why you did what you did, but at the end of it they caught you out, im sure pleading that your sorry might just help you, and pleading guilty might just get you a lesser sentence, good luck!
Personally i think if a woman is going to get herself pregnant from a one night stand she takes the consequence on her head, its tough but thats life, i certainly wouldt expect a poor unsuspecting chap to pay the ultimate price
yes, you will go to prison, get a lawyer and fast.
no he wont go to bloody prison!! like it has been said you must tell the court that you have a child dependent on you and explain depression etc drove you to do what you did . I think maybe you will get a suspended sentence as you have stated that you have never been in trouble before , i really do sympathise with you and i know how desperate you must have felt to be driven to do the false test. Try to calm down about it or else you are going to make yourself really ill. If you can afford a solicitor then by all means get one xx but it would be highly doubtful that a judge will send you to prison for something like this xx
Sorry I need to ask but how did you manage a false dna test?
As others have said I would doubt this would mean a custodial sentence, and also state problems you have previously encountered with the Agency back it up with correspondence etc. if you can.

No PWC has been punished for false declaration, that I can find, and I can find no precedent for an NRP found guilty of DNA fraud in this country. So difficult to predict a likely outcome.
I am aware of an NRP being found guilty of a giving a false DNA test, he was a squaddie who got a friend to take the test on his behalf, he was prosecuted and found guilty – cannot recall what the sentence given was but I don’t think it was custodial,. He was dishonorably discharged from the Army and was left with a criminal record. As he was then proved to be the father of the child in the case he was liable for the child maintenance back to the date he was originally contacted by the CSA

@melinda. Bass are suddenly an expert in law ? He won’t go I’ve also. Googled and have found nothing !! This chap as asked for help and all you came up with is the worst remark ever !! You are just as bad as the CSA scum them selves!!! If it wernt for some of you single mothers or ex partners. Who are so bitter life would be much easier so do the world a favour and keep ya gob shut !! If you ewant to vent off anger the F off to net mums where all you winging cows belong !!! , and naa mate. Stevie, google isn’t a legal adviser and yes, i know quite a bit about law. And yes, this man could get a prison sentence, depending on the circumstances of his actions….. i won’t comment about the rest of your post because it is totally irrelevant.

I will agree with most of the above, a Solicitor seems your best bet at the minute. Just out of curiosity who instigated the DNA test in the first place, the CSA directly, or was it through the Magistrates Court?
This is just the state of UK Justice. The woman has 100% of the rights when it comes to sex and parenting but often try to assign 100% of the responsibility, financial and otherwise, to the man.
A woman has the right to choose whether it is rape, whether to keep any pregnancy that results, whether to keep the baby, whether to stay with its father, whether to inform the father or allow him access, how to bring the child up full stop. Men can stand to be put in prison, fined or registered as a sex-offender on the say-so of any woman they have sex with without further evidence. It is often her word against his and the “justice” system always presumes that women are saints and men villains. Men can also be left “holding the baby” if the woman walks out, even if he never knew about its existence, let alone consented to become a father.
I don’t see how this is sustainable. If men are required to gain clear consent from a woman before sex to avoid a potential rape-charge, then isn’t it reasonable to expect women to obtain clear consent from a man before he becomes a father in order to make any claims against him possible in the future? If a drunken yes doesn’t count in the case of rape, then an informal OK shouldn’t count in the case of parenting.
It would be much the fairer for everybody if women had to obtain a signed and witnessed consent for fatherhood, detailing exactly the terms of responsibility, before they could pursue any later claim for maintenance. This might address the frequency of “one night stands” and other risky sexual behaviour and put paid to the myth that love is ever free.
I feel for Steve G, understand his fear and agree about the total injustice of the situation, but as the law stands it is clear that he is and will always be in the wrong; he is a man after all! If he is not sent to prison, that will only be out of concern for saving taxpayer’s money or squeezing more cash out of him – never out of any concern for what is right.
