I feel I am being held to ransom

My ex husband is now in receipt of a war disablement pension & my csa payments have been stopped totally .he has offered to privately match the csa payment .

can anyone comment if i should apply for variation as he is in full time employment & i believe in reciept of his army pension as well ? He tells me i will recieve nil via csa as in receipt of a “benefit “. i feel i am being held to ransom to accept his offer .

  1. If he is offering to come to a private agreement which satisfies both parties that is all to the good and much better than using the CSA.
    However receipt of a war disability pension alone does not disqualify him from paying child maintenance if he has other earnings and an army pension as taxable income.
    If the earnings and army pension have already been taken in to account by the CSA then a variation will make no difference.
    If you have recently had a nil assessment you could ask for a revision taking these earnings and pemsion into account.
    If your case was opened before 2003 it could be that he has high housing costs and you could ask for a departure from the formula based on this.

  2. If he is offering pay then let him, get the agreement on paper witnessed by a friend or two. Only ever go through the CSA if he refuses to pay what is fair, and even then think it through CSA are a nasty evil organastion thats only thier to ruin the lifes of nrp`s under the pretence of “for the children” . your not being held randsom it sounds like the poor guy is trying to be honest and straight forward, also the guys pension should not be considered income (no benifit should be) but thats just personal opinion

  3. Why are you being held to ransom? Your ex has said he will still pay you but without the csa’s involvement, I don’t understand why you would not happy with this! Do you think you’re entitled to more money, even though your ex is providing?

    Csa are slowly disbanding for nrps and pwcs to come to their own agreement or use the service and be charged for it. Ring child support options to see if you and your ex can mediate and agreement without the csa all together.

    I’m a pwc of 2 who wish my ex was more considerate than yours, I get zilch from him and no offer of anythingso think yourself lucky.

    Can you enlighten me a little bit more about when and what this new CSA change is all about and is there a lead-in time? I can’t wait for this change since I despise the CSA and whilst still having to pay for my child, I will do so without these arseholes sticking their noses in the troth.

  5. Hi gonk, all the info is on the child maintenance options website and I read on a blog somewhere that this is happening sometime in 2014…plus the gingerbread website has been on about it too.

    Cs1 and cs2 will eventually be put onto this new scheme, whether they like it or not and arrears cases put on the back burner (yeah right in our case bollox) those effected by domestic violence will need to provide proof as anyone can use that as an excuse not to mediate with the nrp. I’m not sure if its true but on a leading divorce website csa are no longer taking on new applications and giving pwcs child maintenance options free phone number. Might be worth giving them
    a bell to get more clarification on this because csa haven’t a clue what is what.
