How do you calculate maintenance based on overnight stays?

How do you calculate maintenence for one child who i see one night a week and then another who i don’t see and lives in Australia?

Do you you work it out completely separately?

Also if you find out you have a child 10 years after birth are you supposed to make back payments?

My ex went to USA to live and for 4 years did not have to pay me a penny,CSA told me they couldnt touch him over there ,Not sure about Australia but I am sure if you dont have to pay CS you could put a little in a bank account each month for the child.Regarding overnight excess I am sure that you have to have the child 2 nights a week to cut your child support down,not really 100% on this ,but I am sure that someone on this forum will be able to help you better.Two sites might make useful reading and that is FOOTPRINT and http://www.nacsa.cco.uk

  2. You can only pay maintenance from when the csa first contact you re a claim. Unsure about Austalia but there is a reciprocal agreement with agencies in other countries but I am unsure how successful these actually are.

    Does the child who you see one night a week and the one that lives in Australia have the same mother or different ones?

    Is the child you became aware of 10 years after birth in addition to the two you have already mentioned?

    Have any of the mothers applied to the CSA?

    Is child support being paid through the CSA for any of the children OR by direct private agreement?

    The child in Australia and in UK have different mothers.

    There are only 2 children one here in Uk and one in Australia.

    There has never been any involvement with the CSA either here or Australia. I just want to know how to work things out should I need to. I use the CSA calculator for my child in the uk to work out maintenance. I only see my child in th UK one night a week and do holidays for a week a year. No CSA involved in this at all. We have a private agreement.

    I have only just found out about Australian child. So would like to know what is a fair way to work things out – if need to in the future.

    Thanks for clarifying the above.

    As your child in Australia is out of UK CSA jurisdiction I’m unsure you could work it out based on our child support rules, unless the mother of your first child agreed.

    If she did agree, the calculation would be based on 20% of your income (if over £200 pw), divided equally between both PWC, a shared care reduction could then be made from the amount for your second child at a rate of –
    52 to 103 nights reduction 1/7.
    104 to 155 nights reduction 2/7.
    156 to 174 nights reduction 3/7.
    175 or more nights reduced by half and an extra £7.
