How do I stop paying for children who may not be mine?

I’ve got six kids, well i thought i had six kids apparantly I’ve only got three. All these kids are with the same woman, they all have my surname, but then i get told all there surnames have been changed without my permission unless she forged me signature. I dont know, but then she tells me only three of them are mine and im payin csa on all six. How can i stop payin for three of them if they’re not mine and on birth certificates they’ve got my name? How can i stop that? I dont wana be payin for kids that aint mine. It’s really doing my head in. All them years i loved and cared for three kids that i thought was mine.

  1. when was your CSA case opened?
    when your ex made her application was your first point of contact with the agency by phone or did you complete a MEF (Maintenance Enquiry Form)? … either way you would be asked to confirm that you accepted paternity of the children. Did you question paternity of the 3 children at the time?

    If you accepted paternity at the time then unless your ex confirms to the agency that you are not the father of these children you will need to apply for a declaration of non parentage via your local magistrate’s court.

    First thing to do is contact the agency, tell them that your ex has told you that you are not the father of 3 of the 6 children you are paying for and ask that she be contacted and asked … if she says no you are not the father of these children then they will be removed from the case. If she does not then you will need to go down the court process,

    If your case is on CS2 (opened after 03/03/2003) the maintenance you pay will not be reduced by removing 3 children from the case … you will currently be assessed on 25% of your net income, the assessments are done based on 15% of NRP income for 1 child, 20% for 2 children and 25% for 3 or more … so for the time being you would still be assessed at 25% of your net income. This would of course reduce to 20% when the first of the 3 remaining children is no longer eligible for CM and then again when the next child is no longer eligible.

  2. Other option is to get a DNA and take her to court for fraud. But by the sounds of it you will not of overpaid at all and she would not of gained financially.
