How can they just open up a new case for the same child?

Been paying my ex for a long time now, was on the very old system, she tried to migrate it on to the new system but I managed to contest it and stop it.

I had a nil assessment although I did have arrears. Been paying arrears for what seems like forever. Anyhow last February had a letter from the CSA saying that the ex had split from her new hubby and that there was now a claim in against me.

I contested this as I had a case already for my daughter. My daughter who was 16 then was just getting ready to take GCSE’s. I argued for a while with them, telling them that my daughter was going to be leaving school and education soon and could they prove to me that they had a case against me, also asked them to find the case that I was still paying and as it was by DEO I had nothing to do with it.

I heard nothing from them since June when I asked them to get proof. Anyway, the DEO still kept leaving my salary as usual up until November. I thought, well that must be to do with 6 months after her leaving school or something. I hear nothing from the CSA until 1 week ago, nearly a year on, now saying that I owe them a £2000 odd pounds in arrears for the last year and that i am liable for £200 a month going forward.

They state they have informed my employer to take £400 odd pound out of me a month for the next year or so. I do not know what to do?

I cant afford £400. Are they right and can they do this??

Any ideas? I don’t know if my daughter is still at school. I know she has been accepted into Art and design this year but I have no idea what she is studying. Does she have to be studying a levels in order to get this.

Any help would be appreciated.

  1. If the PWC wants a case to migrate all they have to do is ask for the present case to close wait for 13 weeks and then make a new application.
    If there was a nill assessment on the CS1 system and the NRP has a regular income this will be of advantage to the PWC.
    Child maintenance now continues up to the age of 20 as long as the QC is in full time non advanced education.
