My friend’s ex who she is still married to but have been apart from for over a year signed the birth certificate to her youngest child knowing it wasnt his son she was pregnant with. He later decided he couldnt live with the situation. They also have two other children of thier own. He now has a girlfriend of two weeks and wants to marry her. he wants her to sign the divorce papers and then said he is going to be changing her son’s last name.
She wants to sign the divorce papers but wants her son to have the same last name as her other two children. She doesnt want him to have an rights to her son and neither does he but can he change his name just because he’s not his father?

a birth certficate is legal fiction and is not proof hes the father
and get a dna test done once you have that proof the csa wankers will not have a pot to piss in
im not 100 % sure but i dont think he can just change her sons surname, he has signed the birth certificate agreeing to his surname being taken as the childs full name and although you can change a childs surname by either deed poll or through adoption both “parents” have to be agreeable to this so without both parents permission the name would not beable to be changed! she should maybe ring her local court to find out for sure as they can be very helpful at giving advice (and its free) if she explains situation to them.
truth is also correct in stating that she can not claim child support from him as a dna test would prove to csa that he is not the father
