Father receives refund from the CSA

A father in South Tyneside has been refunded thousands of pounds wrongly taken from him by the CSA.

The 49-year-old man, who wishes that his identity be kept secret, was made to pay too much in maintenance to the Child Support Agency over almost ten years following a computer error.

In that time, he paid over £12,000 to the agency, when the amount he owed should have been just under half of that amount.

The error was detected by his new partner, who queried a bill he received for more than £6,000 from the CSA.

She said:

“What’s happened to my husband is absolutely disgusting.”

“He had to struggle to meet all the demands they put on him, and we would still be paying out cash now if I hadn’t rang to ask what exactly he was paying for”

“Don’t get us wrong – he did not mind paying for his son and he was aware of his responsibilities, but the way everything has happened has been terrible.”

The father originally split from the mother of his son in 1999, and was told to pay £6,000 towards his upkeep. He started his payments at the rate of £69 per month, but five years later was told that his file had been handed over to a debt collection agency.

He continued his payments, only stopping when his son left the UK in September 2008. However, an arrears bill for £6,000 landed through his letterbox in January 2009. He began making payments at the rate of £101 per month, but was told to increase them the following Christmas.

Fed up, they contacted the Child Support Agency who admitted that the record of his payments had not been kept up to date, and that the money would be refunded £6,716 including a further £200 ex gratia payment.

However, the situation dragged on for so long that they wrote to David Miliband, MP for South Shields, to intervene. He wrote to the Secretary of State for Work and Pensions, Iain Duncan Smith, who in turn motivated the CSA to repay the money. In all, they waited six months for their refund.

Praising Mr Miliband, the wife commented:

“I honestly can’t thank him enough for what he has done. The CSA were more than happy to keep demanding payments from us, but when the shoe was on the other foot they prolonged paying out.”

“I think it’s an absolute disgrace this can happen, and if it’s happened to us then it can happen to anyone.”

“Often people see official-looking letters demanding cash and feel obliged to pay without questioning them.”

“But we’re urging other families to stand their ground, and get things checked out if there are any doubts.”

    Maybe we should all lobby David Milliband and see where that gets us.

    And I would love to believe that the csa gave someone some money back,…. that would be a miracle…
