Ex works in the oil industry overseas and earns thousands each month

I have been dealing with the CSA for the last 10 years and not once during one of those years have they collected the correct amount of money from my ex husband who works in the oil industry mainly overseas. To let you understand he is a habitual liar and will go to any length not to pay for his Son.

His job is not like Joe the postman or Larry who works in the same office 52 weeks a year where it is possible to arrest wages etc. Some months he works and earns £20-30K and other times he doesn’t work for a month or so, regardless during any financial year he earns a six figure salary according to some of his P60s £240K. His earnings are way above the national average. For the last couple of years he has been working in Canada, Cairo and elsewhere but on his return home to Auchnagatt he then drives up to the Job Centre in Peterhead and signs on in pretence of being unemployed when in actual fact he is taking the statutory time off from work that by law a Saturation Diver is forced to take.

He was paying £129 per week for a couple of years, which meant he was earning £60K, having supplied evidence to the Tribunal and their findings was he was acutally earning double and the payments should have been £258 per week, all those years he should have been paying double yet he lied knoeing full well that he was not supplying the correct info, they were asking for a couple of payslips so he chose to send them a couple of the lower amounts despite me telling them over and over that that was not going to provide a true reflection of his earnings as he never got the same two months running and it was a waste of time, so it was no wonder that they never calculated the correct amount and all the back payments were worked out but again due to his pretence on being unemployed he was never forced to pay the correct amounts.

The CSA sent me a new payment schedule for NIL which was absolutely shocking to me that someone who was earning obscene amounts of money should never ever have a payment reduced to nil. Two minutes later a payment schedule was upped to £5 per week again total nonsense.

I was absolutely outraged once again and proceeded to commence Tribunal proceedings again. From start to finish the tribunal was supposed to take 4 months, mine took EIGHT months and during all this time the CSA said they couldn’t do anything and the payments had to remain at £5 per week until the tribunal hearing was heard. Once again I provided all the evidence that I had as he was going on Face Book and blatantly laughing at the CSA bragging about spending money on this that and the next thing, buying a house, rangerover and motorbikes, 3 rottweilers etc etc etc. The hearing was 26 June and no surprises that he didn’t show face, instead he sent a letter trying to plead his innocence which was totally thrown out.

The decision was he had earnings to support payments of £288 per week backdated to Feb 2011. Great I thought brilliant at last he has been found out to have lied to the CSA his P60s don’t lie and so naturally I was looking forward to the monies that my Son was due, long over due. But no, I received a phone call from the CSA yesterday she said that he had paid £550 and the other £550 would be paid in October that was the backdated amounts he was due???

Sorry I said what are you talking about he is due thousands and thousands according to the decision of the Tribunal.

No she said by law if he is unemployed he does not have to pay? I said how on earth can he be unemployed if his P60s are stating figures that support payments of £288 per week. She said she was doing her job and that was the law. I said I thought the law said that he needs to pay 15% of nett salary, he does not get a regular weekly/month salary the only way to work out his payments are via his P60 at the end of the year.

What is the point of waiting 8 months to be heard at the tribunal and then the CSA go back to carrying out their nonsense calculations that were the very reason you went to tribunal in the first place. The CSA have allowed him to get away with paying nothing, it is all wrong. The admin people that you speak to don’t have a clue what they are doing they are totally and utterly incompetent. What a waste of tax payers money. Everyone cannot believe my case and how he is getting away with not supporting his son. They are talking about taking their passports away, tagging them and even jail sentences blah blah blah!! Whoever is running the CSA is a complete and utter joke, I am totally and utterly fed up with them.

A father who has been asked to pay £5 per week is someone who is unemployed or on minimum wage not a guy who is earning £150-£200K per year. How can you fight it, how can you take the CSA to court how can you take your childs Father to court, it costs so much money, we barely can afford to cloth and feed him.

The CSA let down child after child they simply don’t give a damn. Its time the Prime Minster woke up and took note of what is going on and make these dead beat father take their responsibility of maintaining their children.

Finally, what options are there for me know, I have gone to Tribunal and the CSA are taking no heed so where do I go now tell me?

  1. Go to your MP and get him/her involved. Ask to get the Criminal Compliance Unit involved.

Lol…first of all the csa don’t give a shit about the kids…so letting them down as you call it, don’t even register in their books.
Secondly who and what the hell do you think you are thinking your are entitled to over a grand a month for 1 child ?
That’s what pisses me off about you greedy ex’s is the amounts you would screw a NRP for each month if you could.
Until a fairer system is in place that’s fair to BOTH parents and not heavily weighted in favour of the PWC…..then I have no sympathy for you

Thank you for your comments which you are quite entitled to, however I am not looking for your sympathy. You are making sweeping statements which are of no use to anyone. The crux of the matter is by law Father’s are supposed to provide 15% of their nett income. Because my child’s Father is in the highest wage bracket does NOT make me greedy. I am simply trying to enforce my child’s Father to accept his responsibilities and take care of his Son, financially & emotionally. Of course Father’s who decide to persue maintenance through the CSA really are no more interested in their children than fly in the air, you shouldn’t need anyone to force you to look after your OWN child, you should want to do it and not be so self absorbed and selfish to your own needs. If you were looking at my case with an open view you would see without a shadow of a doubt that its not I who is greedy but HIM!! Fair to both parties!!! LOL!.
