Ex wants to move to a better area and wants me to pay more for it

I bring home £2400 each month and my daught stays with me 2/3 nights per week. I pay my ex partner £300 each month direct debit into her account.

Our child is 10 months old and my ex states that she has no money, she wants more money as she states she wants to move address to raise our hild in a better area and suitable accommodation. I feel stuck and emotionally black mailed. Do I need to pay her any more when she states that she has no money.

I obviously buy our daughter clothes and food and have just paid for her swimming lessons which I don’t mind at all which I believe is only the right thing. What do I do?

  1. if your case was being assessed through the CSA the calculation would be as follows:

    on £2400 net pay per month this makes an average weekly wage of £553.85
    for 1 child the Maintenance Calculation would be 15% of your average weekly wage = £83.08 – this is rounded up or down to nearest £ so your Maintenance Calculation would be £83.
    As you have your daughter on 2/3 nights per week you would be eligible for a shared care allowance – I have pitched this at 5 nights per fortnight and work this to be bandwidth 2 – your SC allowance would therefore be 2/7th of your MC – this gives a SC allowance of £23.71 per week
    your weekly liability would be your MC less your SC – £83 – £23.71= £59.29 per week – converted to calendar monthly payments (59.29 x 52 then / by 12) this means you would be liable to pay £256.92 per week

    if you choose to spend extra on your child – ie clothes, food, toys & activities then this would not be deducted from your liability unless your ex accepted these in lieu of child maintenance.

    Based on your post, if you used the CSA your liability would be approx £257 pm.
    As long as there were no change to circumstances, this would remain your CSA liability and you would not be expected to contribute further, unless you wished to.

    If you and your ex have a private arrangement, it will obviously depend on what you have agreed and what you both consider in the best interest of your daughter.

    Does your ex live in an undesirable area / is their accommodation unsuitable?
    Did your ex move out of a home you had together?
    What’s your ex’s position – is she a f/t mum or does she work or does she claim benefits?

  3. apologies – I did mean per month and not per week, CSA work in weeks so it’s often a case of converting from monthly to weekly and back up again
