Ex wants to claim CSA when we both have one child each

My daughter lives with me but my son who I do not see lives with my ex who is remarried. Her and her husbands income is a lot higher than mine. I always paid maintenance for both children but when my daughter decided she wanted to come and live with me myself and my ex agreed I would support my daughter and her my son.

She has now decided to put a claim in to the CSA. I contacted them and they told me it was greed but there is nothing they can do about it is this true?

My daughter is fifteen and my son thirteen.

    yes it’s true, if your ex has a child living with her she can make a claim via CSA for child maintenance, equally as you have a child living with you then you can also claim CM via CSA from your ex partner.

    Both claims will be assessed on the Non-resident parents income.

    You need to make an application, the CSA will not automatically open a case tho.

    What ridiculous childish games.

    But what can you do? If you put in a counter claim, then your ex stands to lose a lot more than you. I would email her that if she seeks to claim maintenance via the CSA, you wont have enough money left to care for your other child, so will have to put in a claim for maintenance from her.
