Ex uses my CSA payments for herself

Been divorced 9 years. 2 children now 17 and 11. Had a court agreement in place with the usual unjust lump sum to her with child maintenance payements as well but the Ex has gone to the CSA and they have now increased the payments but take none of the capital into consideration at all. She is in a win win situation. The kids are getting none of it – she even cuts my sons hair herself!

She is remarried for 5 years, have a 5 bed house and 2 cars but they both only have parttimre jobs – so how are they funding these things?

Because of me and yet my kids get nothing….

    If your court order for child maintenance was before April 2003 then the CSA have no rights to recalculate and collect it without your agrement. If they are then complain to them and your MP as they are acting unlwfully.

    If it was after April 2003 you are stuffed I’m afraid ….

    Same as us….My husbands ex child got not a thing. She has two cars and 1,700+ per month. Three wages comeing in and gets two holidays per year. The CSA don't care. They take off my kids to give to a bad child. Welcome aboard…Richard I see you are pixxed off with the CSA…But it is not his fault is it…

    As above – absolutely nothing you can do about it I'm afraid. My husband pays for his children through CSA and they take his earnings and our child tax credits and disabled credit for my children too. No use fighting it, they just say 'it's the law'. However unfair it seems, I've learnt to just accept it and enjoy life as much as you can.

    The reason they get away with it is because most people allow them to! There IS another way join us on the 28th Feb and show the Government we will not put up with there incompetent theft anymore !!!!!!!!

    CSA wake up to your injustice. shit to it`s the law do any of you live in the real world at all .or are you all living in land cookoo being paid by the tax we pay , and then have the nerve to rob us as well . go find a real job like the rest of us, then pay what you demand to your x and then try to live !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    It's the law? Define what the law is? My understanding is that this is Statute law and requires you to contract with them! After all, the CSA is a company and you are their client, usually without consent.One day, the people will finally open their minds and realise that we are all being screwed!

    The more money you earn the more the CSA take off you, so try and get a part time job either delivering pizzas or a taxi driver – cash in hand jobs.

    What are we supposed to do to fight it? When the CSA said they were taking our chiild and working tax credits and also money I receive for my disabled child into account, my husband tried to dispute it. He said he was willing to pay 25% of his wages, but not my tax credits as we need them for my own children. He also said he didn't want the deduction for stepchildren as this wasn't right. They said if he didn't pay, they would build arrears and take us to court, do a doe, possibly sending in bailiffs and other measures to get the money. I called the tax credits office and told them what was happening and they seemed oblivious to it and didn't know what to say.Should we refuse to pay it? I went to the CAB and they said we had to pay it.We struggle to make ends meet now and I've taken longer hours at work to make up the shortfall as they can't, apparantly, touch my own earnings. What makes me laugh is that my husband's ex has him over a barrel – she says that we can only have his children over night if we don't tell the CSA – if we do, she stops overnight contact. It's so unfair.
